REQUEST: -,Waiver of minimum side yard setback to retain a storage shed.
Having been appointed Zoning Administrator by the Director of Community
`..Development, pursuant to Anaheim Municipal Code Section 18.12.060, to decide
the above-ref erenced petition and a public hearing having-been duly noticed
for and held on the date set forth above, I do hereby find, that:
1. That there are special circumstances applicable to the property
such as size, shape (rather narrow), topography with substantial
-grade differences to adjacent properties and no blockage of the
.view, location or surroundings, which circumstances do not apply. to
other identically zoned properties in the vicinity; and
2. That strict application of the Zoning Code deprives the property of
privileges enjoyed by other properties in identical zoning
classification in the vicinity.
3. That. the closest residential structure is located further than
70-f eet to the. west and only has View of the roof of the storage
shed; that the storage shed is well designed and of high quality
and is not visible from the street.
4. That the requested waiver is minimal.
ENVIRONMENTAL IMPACT ANALYSIS: it was noted the Planning Director or his
authorized representative has determined that the proposed project falls
within the definition of Categorical Exemptions, Class 5, as defined in the
-State Environmental Impact Report Guidelines and is, therefore, categorically
exempt from-'the requirement to prepare an`EIR.
'Based on the evidence and testimony presented to me, i do: hereby determine to
approve Variance No. 3689, subject to the following conditions:
(1) That prior to final building and zoning inspections, or within a
period of ninety (90) days from the date of this decision, '
whichever occurs first, the property owner. shall prepare and record
a covenant limiting the use of the storage building, "horse barn"
to storage only with no animal confinement or residential uses
permitted in said structure. A copy of the covenant shall be
submitted to and approved by the City Attorney prior to
recordation. A copy of the recorded covenant shall be furnished to
the.Planning Department.

2. That subject property shall be developed substantially in
accordance with plans and specif ications on file with the City of
Anaheim marked Exhibit-Nos. 1, 2, and 3.
3. That prior to the final building and zoning inspections, or within
a period of :ninety (90) days from the date of this decision,
wh ichever occurs first, Condition Nos. l and 2, above-mentioned,
shall be complied with.
This decision is made, signed, and entered into the file this 2nd day of
