Having been appointed Zonin Administrator by the Director of Community
Development, pursuant to Anah im Municipal Code Section 18.12.060, to decide
the above-referenced petition nd a public hearing having been duly noticed
for and held on the date set fo th above, I do hereby find, that:
1. 'That there are. special circ tances applicable to the property such as
size, shape, topography, locat'on or surroundings, which do not apply to
other identically zoned propert'es in the vicinity;
2: That strict application of the Zo ing Code deprives the property of
- privileges enjoyed by other proper ies in identical .zoning classification
in 'the vicinity; and
3. That the retaining wall. structure and covered patio additions will not be
visible from the street because of the substantial slope; ,that the
structures will be located about 90 fee from the edge of the slopes and
that the-proposals primary. purpose is to erve as a retaining wall which
includes large storage area and if it were a retaining wall only, a
.waive r. would not be required.
Based on the evidence and testimony presented to m I do hereby determine to
'approve Variance: No. 3688, subject to the following conditions:.
1. That subject property shall be developed s bstantially in
accordance with plans and specifications on file with the City of
Anaheim marked Exhibit Nos. 1 and 2.
2. That prior to final building and zoning inspec ions, Condition No.
1, above-mentioned, shall be complied with.
3. That .approval of this application constitutes app val of the
proposed request only to the extent that it complie with the
Anaheim Municipal Zoning Code and any other applicab a City
regulations. Approval does not include any action or findings as
to compliance or approval of the request regarding any other
applicable ordinance, regulation or requirement.
