REQUEST: Waiver of minimum dimensions of parking spaces to retain a-work
shop..
Having been appointed Zoning',Administrator, pursuant to Anaheim Municipal Code
Section 18.12, 060, 'to decide the above-referenced petition and a public
hearing having been duly noticed for and held on the date set forth above, I
do hereby find,. that:
1. That there are special circumstances applicable to the property such as
size, shape, topography, location or surroundings, which do not apply to.
other identically:`zoned properties in the vicinity; and
2. That strict application of the Zoning Code deprives the property of
privileges; enjoyed by other properties. in identical .zoning classification
in the vicinity.
- 3: That usage of the workshop shall be limited to personal study and hobby
activities and will not be used for business that might generate noise.
4. That the ,waiver is minimal and on-site parking is available, although not
in the garage; and that the property owners will record a covenant
agreeing'.,to`return the=garage to its .:original condition (.two 10' x 20'
parking spaces inside`the garage)_prior to sale of the property or other
transfer of-ownership,..
ENVIRONMENTAL'IMPACT REPORT STATUS:
.That the: Planning Director or his .authorized .representative has determined
that the proposed project falls within the definition of Categorical
Exemptions, Class 5, as defined in the State Environmental Impact Report
Guidelines and is, therefore, categorically exempt from the:-requirement to
prepare an EIR.
Based on>the evidence and testimony presented to me, I do hereby determine to
approve Variance No. 3703, subject to'the fallowing conditions:
L. That plans shall be submitted to the Building Divsion''showing compliance
' with the minimum standards of the City of Anaheim, including the Uniform
Building, Plumbing,. Electrical, Housing, Mechanical and Fire Codes as
adopted by the'City of Anaheim. The appropriate permits shall be
obtained :for any necessary work.

2. That subject property shall be developed substantially in accordance with
plans ,and specifications on file with the City of.Anaheim marked Exhibit
Nos. 1`~and 2.
3. That,a covenant shall be recorded against the property guaranteeing
removal of the wall modification establishing the workshop prior to the
sale or transfer of the, property; and that this Variance shall terminate
upon such sale-or transfer of the property and another variance would
have to be approved in order to keep the workshop.
4. That Condition Nos. 1, 2, and 3, above-mentioned, shall be completed
within a period of 90 days from the date of this resolution.
5. That approval of:this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City regulations. Approval does not
include°any action or findings as-to compliance or approval of the
request regarding any other `applicable ordinance, regulation or
requirement.
