DATE OF PUBLIC HEARING: November l9, 1987 SUPPORT: Petition containing 33 signatures_in support of the proposal submitted by the petitioner at the public hearing. Trenton Drive, Anaheim, CA 92802 LOCATION: 1306 West Trenton Drive REQUEST: Waivers of (a) required type of parking spaces and (b) minimum rear yard setback to retain a garage conversion, a room addition and a detached storage room. Having been appointed Zoning Administrator by the Director of Community Development pursuant to Anaheim Municipal Code Section 18.12,040, to decide the above-ref erenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find, that: T. That the petitioner proposes the following waivers from the Anaheim - Municipal Code, in order to retain a garage conversion, a room addition. and a detached storage room: (a) Sections 18.06.050.011 - Required type of parking spaces. 18.06.080. (4 spaces with 2 in a garage required; -18.12.060.110 4 uncovered spaces existing) and 18.26.066.010 (b) Section 18.12.060.050 -Minimum rear yard setback. and 18.26.063.030 (10 feet required; 4 and 6 feet proposed) 2. .That waiver (a) is minimal because a greater .number of parking spaces than required are available on-site and there is adequate space for future construction of a 2-car garage, in accordance with Zoning Code standards. 3. That waiver (b) is-minimal amounting to only a 3-f oot deviance from the minimum setback between the room addition and the rear property line and that open space similar to the amount displaced by the room addition is available elsewhere on subject lot; and .that the detached storage room is a non-inhabited accessory structure which,`if it did not have a foundation and electrical utilities, would be permitted as it currently exists. 0107T ZA87-37 Page 2 Variance No. 3730 4. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity. 5. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning class if ication in the vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal to retain a garage conversion, a room addition and a detached storage room with waivers. of required type of parking spaces and minimum rear .yard setback on a rectangularly-shaped parcel. of land consisting of approximately 7,255 square feet,. having a frontage of approximately 66 feet on the south side of Trenton Drive and being located-:approximately 550 feet east of the centerline of Ninth Street, and further described as 1306 West Trenton Drive; and does hereby approve the Negative Declaration upon finding.. that she has considered the. Negative. Declaration together with any comments received during .the public review process and further_f finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a sign if icant"effect on the environment.- Based on the evidence and testimony presented tome, i-do hereby ,determine to approve Variance No. 3730, subject to the following conditions: 1. That plans shall be .submitted to the Build ng Division showing compliance with the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes' as adopted by the City of-Anaheim. The appropriate permits shall be obtained for any necessary work. 2. 'Thatsubject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos, l through 3, and_that the existing paved driveway in front of the " house shall be maintained as shown on the exhibits, with parking space for 6 or more vehicles. 3. That Condition Nos. l and 2, above-mentioned, shall be, completed within a period of one hundred twenty (120) days from the date of this decision. 4. That. approval of this application constitutes approval of the proposed request-only to the extent that it complies with: the Anaheim Municipal. ' Zoning Code and any other applicable City regulations.
