Having been appointed Zoning Administrator by the Director of Community Development, pursuant to Anaheim Municipal Code Section 18.12.060, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set-forth above, I do hereby find: 1. That the proposal. to permit waiver of maximum fence height in the front yard (3 feet permitted; 6 1/2 foot block wall with 7 1/2 foot pilasters proposed) is authorized by Code Section 18.04.043.101..... 2. That a prior variance (No. 1941) was granted in 1968, permitting maximum $ foot high fences to be constructed in certain front, side, and rear yards at'the time when the underlying subdivision was originally being developed. 3. That there is a 42-inch high electrical .box adjacent to the south property line and that the block wall located south of petitioner's driveway shall be no higher than 42 inches in that. area and within a distance of 9 feet from the front property line. 4. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; 5. Than ..strict application of the Zoning Code .deprives the property of privileges enjoyed by other properties in identical zoning classification in thevicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator. has reviewed the proposal .to retain'a 6-foot-high .fence with waiver of 'maximum fence height. in front yard on a rectangularly-shaped parcel of land consisting of approximately 6,OOO,square feet, having a frontage of,approximately 60 feet on the west side of Pembrooke Lane, having a maximum depth of approximately l00 feet and being. locatedapproximately 92 feet south of the centerline of Pembrooke. Lane and further described as 1345 Pembrooke Lane;. and the Zoning Administrator ;or her authorized-representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 3, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. 0123T ZA87-39 Page 2 Variance No. 3715 .Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. `3715, in part, ..requiring the portion of the. block wall located south of the driveway to be lowered to forty two (42) inches, and subject to the following conditions: 1. That fencing plans shall be submitted to the Building Division showing compliance with the .minimum standards of the Uniform Building Code as,adopted by the City of Anaheim. The appropriate .permits shall be obtained for any necessary work. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. l of Exhibit No. land Exhibit Nos. 2 through 5; provided, however, that the block wall south of the driveway shall be lowered to a maximum of forty-two (42) inches where located within a nine (9) foot distance from the front .property line. 3. That Condition Nos. 1 and 2, above-mentioned, shall be completed within a period-of ninety (90) days from the date of this decision. 4. That approval of this application constitutes approval of the proposed .request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other. applicable City regulations.' Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
