Having been appointed Zoning Administrator by the Director of Community Development, pursuant to Anaheim Municipal Code Section 18.12.060, to decide the above-referenced petition and ,a public hearing having been duly noticed for and held on the date set forth above, I do hereby find:. 1. Petitioner requests waiver of the following under authority of Code Section 18.12.060.040 to construct a 36.5 foot high, 2-story single-family residence: SECTIONS 18.12.060.040 - Maximum structural height. and 18.84.042.011 (25-feet permitted; 36.5 feet proposed). 2. That any hardships in developing this property. are :self-created because when the property was subdivided into its current configuration, it was done to the minimum Scenic Corridor Overlay .and RS-HS-22,000 Zone standards (which standards are still in effect) without any consideration being given to the steepness of the property, thereby making. future development difficult. 3. That there are no special circumstances applicable,to the property such as size, shape, topography, location or surroundings because other identically zoned properties in the vicinity (both developed and undeveloped) have similar configurations; and 4. That strict application of the Zoning Code does not deprive the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING:.
