Waiver of minimum number of parking spaces to construct a 32,058 square foot addition to an existing industrial building. Having been appointed Zoning Administrator by the Director of Community Development, pursuant to Anaheim Municipal Code Section 18.12.060, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do .hereby find, that: 1. Petitioner requests waiver of the following under authority of Code Section 18.12.060.110 to construct a 32,058 square foot addition to an existing industrial building: SECTIONS 18.06.050..0212, - Minimum number of parking spaces. 18.06.050.031, (723 required; 390 proposed) 18.D6.050.033, 18:06.080, .AND 18.61.066.050 2. That the minimum number of parking spaces required by code can be provided if the 50-foot wide landscaped front setback is paved and striped and, therefore, if the need for additional parking spaces arises, such spaces can be provided on-site. 3. That .the parking waiver will not cause an increase in traffic congestion in the immediate vicinity nor. adversely affect anyadjoining land uses' and granting of the parking waiver under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL OUALITY'ACT FINDING: That the Zoning Administrator has reviewed the proposal to construct a 32,058 square foot addition to an existing industrial building with waiver of minimum number of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 18 acres, having a frontage of approximately 810 feet. on the north side-of La Palma Avenue, having a maximum depth of .approximately 966 feet and being located approximately 480 feet east of the centerline of Kellogg Drive and further described as 5115 East La Palma Avenue;.and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with `any comments received during the public review process and 'further finding on the basis of the initial study and any comments received 0126T ZA87-41 Page 2 Variance No. 3733 • that there is no substantial evidence that the project will have a significant effect on-the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3733, subject to the following conditions: 1. _That sidewalks shall be: installed along La Palma Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the .Office of the City Engineer and that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to•the City of -Anaheim, shall be posted with the City. to guarantee the satisfactory completion-of said improvements. Said security. shall be posted with the ,City prior to issuance of a building permit, to .guarantee the installation of .the above-required improvements prior to occupancy. 2. That :prior. to issuance of a building permit,'the appropriate major .thoroughfare and bridge fee shall be paid to-the City of Anaheim in an amount as specified in the Major Thoroughfare and. Bridge Fee Program .for the Foothill/Eastern Transportation Corridor, as approved by City Council Resolution No. 85R-423. 3. That prior to issuance of a building permit, the appropriate traffic signal assessment fee-shall be paid to the City of Anaheim in an amount as determined by the City Council. 4. That `drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 5. That the new construction authorized by this resolution shall be served by underground utilities. 6. That fire sprinklers shall be installed as required by the City Fire Marshall. 7. That trash storage areas shall be provided and maintained in accordance with approved plans on file with the Street Maintenance and Sanitation Division, 8. 9. That all air conditioning facilities and other roof and ground mounted equipment shall be properly shielded from view. That subject property shall be `developed substantially in accordance with plans and specifications on file-with .the-City of Anaheim marked Exhibit Nos. l through 6; provided, however, that there shall be ei her a (a) minimum of .four hundred (400) parking spaces if the width of the small car spaces is 7 1/2 feet or {b) a minimum of three hundred ninety (390) spaces if the width of the small car spaces is eight (8) feet. 0126T 2 ZA 87-41 w • Page.3 Variance No. 3733 10. That prior to issuance of a building permit, or within a period. of one year from the date of this decision, whichever occurs first, Condition Nos. 1, 2, and 3 above-mentioned, shall be complied with. Extensions for, further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code.. 11. That prior to final building and zoning inspections, Condition Nos. 1, 4, 5, 6, 8, and 9, above-mentioned, shall be complied with. 12. That approval of-this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City regulations. `Approval does'not include any action or findings as to compliance or approval of the request regarding any other applicable .ordinance,. regulation or requirement.
