DECISION OF THE ZONING ADMINISTRATOR - ZA 88-20

REQUEST: Petitioner requests waiver of the following under authority of the
Code Section 18.12..060..110 to retain an approximate 180,000 square
foot warehouse and wholesale distribution facility:

Having been appointed Zoning,Administrator,by the Planning Director, pursuant
to Anaheim Municipal Code Section-18.12.040, to decide the above-referenced
petition-and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find, that:
1. That the parking variance will not cause an increase in traffic
congestion in he immediate vicinity nor adversely affect any adjoining
land uses;
2. That the. granting of the parking variance under he conditions imposed
will not be `detrimental to the peace, healh, safety or general welfare of
the citizens of the City of Anaheim; and
3. That on-site space is available for the Code-required number of parking
spaces if the uses or businesses on the property change at some future
date and necessitate additional parking. -
CALIFORNIA ENVIRONMENTAL QUALITY ACT 'FINDING: ,That the Zoning Administrator
has reviewed the proposal to ;retain an approximately 180,000 square-.foot
warehouse and-wholesale distribution facility on an irregularly-shaped parcel
of land consisting of approximately 16.8 acres, having a frontage of
approximately 590 feet on the north side-of Katella Avenue having a maximum
depth of approximately 1,457 feet and being located: approximately 740 feet
west of the centerline of State College Boulevard and further described as
1515 East Katella Avenue (General Foods); and does hereby approve the Negative
Declaration upon finding that she has-.considered the Negative Declaration
together with any comments received. during the public review process and
further finding on the basis of the initial study and any comments-received
that .there is no substantial evidence .that the project will have a significant
effect. on the environment.

Based on the evidence and testimony presented to me, I do hereby determine to
...approve Variance No. 3775, subject to the following conditions:
1. That prior to the commencement of the activity authorized under this
decision, or prior to final building and zoning inspections, or within a
period of ninety (90) days from the date of this decision, whichever
..occurs first, the owner(s) of subject property shall execute and record a
covenant in a form approved by the City Attorney's Office wherein such
.owner(s)- agree not to contest the formation of any assessment district(s)
which may hereafter be formed pursuant to the provisions of Development
Agreement No. 83-01 between. the City of Anaheim and Anaheim Stadium
Associates, which district(s) could include such owner's property.
2. That curbs and gutters shall be removed and/or reconstructed along
Katella Avenue as required by the City Engineer and in accordance with
-standard plans and specifications on file in the Office of the City
Engineer.
3. That sidewalks shall be installed `along Katella Avenue as required by the
'.City Engineer and in accordance with standard plans and specifications on
file in 'the'Dffice of the City Engineer.
4. That subject property shall be developed substantially in accordance with
-plans and specifications an 'file with the City of Anaheim marked Exhibit
No. 1
5. That .prior to-the commencement of he_activity authorized by this
...decision ('final building and zoning "inspections,of.the building currently
-under construction), Condition Nos. '2, 3, and 4, above-mentioned, shall
be complied with. Extensions for further time to .complete said
conditions may be granted in accordance-with Section 18.03.090 of the
Anaheim Municipal Code..
6.. That approval-of this application constitutes approval of the proposed
request only o the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City regulations. Approval does not
include any action or findings as'to compliance or approval of the
request regarding any other applicable ordinance,..regulation or
requirement.
