REQUEST: To construct a covered porch with waiver of Code Section
18.23.063.011 "Minimum Front Setback" in conjunction with a new
single-family residence at the northeast corner of Owens Drive and
Danielle Circle.
DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide
the above-referenced Administrative Adjustment, said Administrative Adjustment
having been duly noticed and no written objections having been received during
the public notice period ending May 30, 1988, _I do hereby find, pursuant to
Section 18.12.080:
1. That the request conforms to Code Section 18.12.080.010 which permits a
maximum'20~ deviance from the front yard setback requirement in the
RS-HS-22,000(SC} "Residential, Single-Family Hillside - Scenic Corridor
Overlay Zone" (25 feet required; 20 feet proposed).
2. That the request, as shown on Exhibit Nos. 1 through 3 on file with the
City of Anaheim, is minimal and consists of a covered porch of which less
.than-100 sq.ft. encroaches into the required front setback.
3. That there are special circumstances applicable to the property such as
size, shape., topography, location or surroundings, which do not apply to
other identically zoned properties in .the vicinity.
4. That strict application of the Zoning Code deprives the property of
privileges enjoyed by other properties in identical zoning classification
in the vicinity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator.
has reviewed the proposal to construct a covered porch with waiver of minimum
front setback (25 feet required; 20 feet proposed) in conjunction-with anew
single-family residence at the northeast corner of Owens Drive and Danielle
Circle; and that the Planning Director or his authorized representative has
determined that the proposed project falls within the definition of
Categorical Exemptions, Class 5, as defined in the State EIR Guidelines and
is, therefore, categorically exempt from the requirement to .prepare an EIR.'
Based on the evidence presented to me, I do hereby. determine to grant
Administrative Adjustment No. 88-09, unconditionally.

This decision is made, signed, and entered into the file this ninth day of

NOTICE: This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 days of the date of the signing of this decision or unless a
member of the City Council shall request to review this decision within said
