DECISION OF THE ZONING. ADMINISTRATOR - ZA 88-43
PETITION: VARIANCE N0. 3819 CEQA STATUS: NEGATIVE DECLARATION

REQUEST: Petitioner requests waiver of the following under authority of
Code Sections 18.06.080 and 18.12.060.110 to construct 5-story,
103-unit, motel including 1,600 sq.ft. of retail shops:
SECTION 18.06.050.0241 -.Minimum Number of Parking Spaces.
and 18.48.066.050 (88 required; 73 proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
.date set forth above, I do hereby find:
1. That, due to provision of an adequate emergency vehicle turn-around area
at the rear of subject property, the request was modified at the public
hearing for a minimum of 73 instead of 76 parking spaces and that the
City Traffic Engineer indicated that said modification was not a
significant change;
2. That the parking variance will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect any adjoining
land uses; and
3. That the granting of the parking variance under the conditions imposed,
if any,. will not be detrimental to the peace, health, safety or general
welfare of the citizens of the City of Anaheim.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: .That the Zoning Administrator
has reviewed the proposal for waiver of minimum number of parking spaces to
construct a 5-story, 103-unit motel including 1,600 sq.ft. of retail--shops on
a rectangularly-shaped parcel of land consisting of approximately 1.17. acres,.
having a frontage of approximately 85 feet on the east side of Harbor
Boulevard, having a maximum depth of approximately 600 feet, being located
approximately 700 feet south of the centerline of Manchester Avenue and
further described as 1520 South Harbor Boulevard; and .does .hereby approve the
Negative-Declaration upon finding that she has considered the Negative
Declaration together with any comments received during the public review

process. and further finding on the basis of the initial study and any comments
received that there is no substantial evidence that the project will have a
significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
approve Variance No .'3819 for a minimum of seventy three (73) parking spaces,
subject to the following conditions:
1. That a fee shall be paid to the. City of Anaheim for street lighting along
Harbor Boulevard in an amount as determined by City Council resolution.
2. That a fee shall be paid to the City of Anaheim for tree planting along
Harbor Boulevard in an amount as determined by City Council resolution.
3. That prior to issuance of a building permit, the appropriate traffic
signal assessment fee shall be paid to the City of Anaheim in an amount
as determined by City Council resolution.
4. .That the legal owner of subject pr erty shall dedicate to the City of
Anaheim a strip of land seventy ~ feet in width from the centerline of
the street along Harbor Boulevard for street widening purposes.
5. That prior to issuance of a building permit, a faithful performance bond
in an amount. approved by the City Engineer shall be posted with the City
of Anaheim to<guarantee the removal of existing. street. improvements along
Harbor Boulevard and reconstruction/construction of 'full street
improvements at the ultimate location when required by the City Engineer.
6. That all engineering requirements of the City of Anaheim along Sarbor
Boulevard including construction of a sixty (60) foot long variable width
bus transition be complied with as required and .approved by the City
Traffic Engineer.
7. That the proposal shall comply with all signing requirements of the C-R
"Commercial Recreation" Zone, unless a variance is approved by the City
Council, Planning ,Commission or Zoning Administrator.
8. That a parking plan indicating compliance with City parking lot design
standards shall be submitted to and approved by the City Traffic Engineer.
9. That subject property shall be served by underground utilities.
10. That prior to commencement of structural framing, on-site. fire hydrants
shall be installed and charged as required and approved by the City Fire
Department.
11. That the trash storage areas (modified on Exhibit No. l.a.) shall be
provided and maintained in a design and location acceptable to the Street
Maintenance and Sanitation Division and in accordance with approved plans
on file with said Division.

12. That subject property shall be developed substantially in accordance with
.plans and specifications on file with the City of Anaheim marked Exhibit
Nos. I, l.a. and 2 through 6; provided, however, that a minimum of
seventy three (73) parking spaces may be provided, that turf blocks shall
be installed and maintained in the emergency vehicle turn-around area
located in the rear forty (40) feet of subject property and that locked
sliding gates or removable posts need not be installed unless required by
the City Fire Department.-
13. That prior to commencement of the activity authorized by this decision,
or prior. to issuance of a building permit, or within a period of one year
from the date of this decision,: whichever occurs first, Condition Nos. 1,
2, 3, 4, 5, 6 and 8, above-mentioned, shall be complied with. Extensions
for further time to complete-said conditions may be granted in accordance
with :Section 18.03:090 of the`Anaheim Municipal Code.
14. .That prior to final bui ding and zoning inspections, Condition Nos. 6, 9,
11 and 12, above-mentioned, shall be complied with.
15. That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code. and any other applicable City°regulations. Approval does not
include any action or findings,, as to compliance or approval of the
request regarding any other applicable ordinance, .regulation or
requirement.
This decision is made, signed, and entered into the file this twenty-first day

NOTICE: This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City.
Clerk within 15 days of the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said
