DECISION OF THE ZONING ADMINISTRATOR - ZA 88-45
VARIANCE N0. 3820
CEQA STATUS: NEGATIVE DECLARATION
DATE OF PUBLIC HEARING: July 28, 1988, continued from the meeting of July 14,
1988
OPPOSITION: That 9 people indicated their presence at the public hearing in
opposition with 3 people speaking in opposition.

REQUEST: Petitioner requests waiver of-the following under authority of Code
Sections 18.06.080 and 18.12.06.110 to establish a 738 square foot
donut shop:
SECTIONS 18.06.050.022 - Minimum number of parking spaces.
and 18.Ob.050.0233 (36 required; 25 existing)
Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth. above, I do hereby find:
1. .That the proposal will have an adverse affect on adjoining and nearby
.residential uses because vehicular access to subject property is
available via a public. alley which also serves adjacent apartment uses
and which alley connects directly to Reseda Street, a wholly residential
street with .both single and multiple family dwellings, and that said
alley provides direct access from the proposed donut shop to said
residential area;
2. That vehicles which enter and exit the property from State College
Boulevard are adversely. affected by the existing "off-set" traffic
signalization at the intersection of State College Boulevard and Santa
Ana Street/Westport Drive;
3. That a Barking variance will cause an increase in traffic congestion in
the immediate vicinity and adversely affect adjoining land uses; and
4. That that granting of a parking variance will be detrimental to the
peace,. health safety and general welfare of the citizens of the City of
Anaheim.
CALIFORNIA ENVIRONMENTAL oUALITY ACT FINDING: That the Zoning Administrator
hasrevievred the proposal to establish a 738 square foot donut shop with
waiver of minimum number of parking spaces on a rectangularly-shaped parcel of
land consisting of approximately 0.32 acre having a frontage of approximately
149 feet on the east side of State College Boulevard, having a maximum depth

of approximatly l00 feet, being located approximately 168 feet south of the
cenerline of Westport Drive and further described as 506 South State College
Boulevard; and does hereby approve the Negative Declaration upon finding that
she has considered the Negative Declaration together with .any comments
received during the public review process and further finding on-the basis of
the initial study and any comments received that there is no substantial
evidence that the-project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
deny Variance No. 3820.
This decision is made, signed, and entered into the file this 4th day of
August, 1988.

NOTICE: This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 days of the date of the signing of this decision or unless
members of the City Council shall .request to review this decision within said
15 days.
