REQUEST: Petitioner requests. waivers of the following under authority of
Code Sections 18.12.060.040 and 18.12.060.070 to construct a
10-unit, 3-story apartment complex:
(A) SECTIONS 18.34.062,011 - Maximum Structural Height.
and 18.34.062.012 (permitted: 1 story within 150 feet
of single-family residential zoning
and 2 stories otherwise; proposed:
3-stories at 70 feet from RS-7200
zoning)
(B) SECTION 18.34.062.020 - Maximum Site Coverage.
(55°~ permitted; 67~ proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:
1. That there are no special circumstances applicable to the property such
as size, shape, topography, location or surroundings, which do not apply
to other identically zoned properties in the vicinity because nearby
apartments are developed on similarly sized or smaller lots and all are
developed at a lower density;
2. That strict application of .the Zoning Code does not deprive the property
of privileges enjoyed by .other properties in identical zoning
classification in the vicinity because most of the apartments in the area
are 1-story in height and none are 3 stories-high; and
3. That. approval of a 3-story height waiver,. as proposed, would 'establish an
undesirable. precedence in an area consisting primarily of single-story
buildings which have been developed at a lower density.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal to construct a 3-story, 10-unit apartment complex
with waivers of maximum structural height and maximum .site coverage on a
rectangularly-shaped parcel of land consisting of approximately 0.28 acre,
having a frontage of approximately 74 feet on the south side of Romneya Drive,
having a maximum depth of approximately 163 feet, being located approximately
1500 feet west of the centerline of Harbor Boulevard and further described as
806 West Romneya Drive; and does hereby. approve the Negative Declaration upon
finding that she has considered the Negative Declaration together with any
comments received during the public review process and further finding on the
basis of the initial study and any .comments received that there is no
substantial evidence that the project will have a significant effect on the
environment.
Based on the evidence and testimony presented to me, I do hereby determine to
deny Variance No. 3827.
This decision is made, signed, and entered into the file this fourth day of
August, 1988.

NOTICE: This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk .within 15 days of'the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said
