REQUEST: Petitioner request waiver of the following under authority of
Code Sections 18.12.060.110 to reconstruct a fire damaged
industrial building:
SECTION 18.06.050.0212 - Minimum number of parking spaces.
18 06.050.031 (33 spaces-required;
18.06.080 24 spaces proposed)
and 18.61.066.050
Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section .18.12.040, to decide the above-referenced
petition and a .public hearing having. been duly noticed for and held on the
.date set forth above, I do hereby>find:
1. .That the ,proposal is for reconstruction of an industrial building in a
similar configuration and with similar parking. to the previous. site
development. and that other. development along Embassy Street is identical
to the proposal;
2. That approval is for either (a) a minimum of 25 parking spaces with all
small car spaces being at least 8 feet wide or (b) a minimum of 24
parking spaces if the Street Maintenance and Sanitation Division requires
installation of a trash enclosure and with all small car spaces being at
least 8 feet wide;
3. That the variance. will not cause an increase in traffic congestion in the
immediate vicinity nor adversely affect any adjoining land uses; and
4. That the. granting of the variance under the conditions imposed, if any,
will not. be detrimental to the peace, health, safety and general welfare
of .the citizens of the City of Anaheim.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of the minimum number of parking spaces
to reconstruct a fire damaged industrial .building on a rectangulary-shaped
parcel of land consisting of approximately 0.58 acre, .having a frontage of
approximately 124 feet on the south side of Embassy Street,' having a maximum
depth of approximately 205 feet, being located approximately 195 feet east of
the centerline of Loara Street and further described as 1552-1556 West Embassy
Street;.. and does hereby approve the Negative Declaration upon finding that she
has considered the Negative Declaration together with any comments received
during the public review process and further finding on the basis of the
initial study and any comments received that there is no substantial evidence
that the project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
approve Variance No. 3880, subject. to the following conditions:
1. That prior to issuance of a building permit, the appropriate traffic
signal assessment fee shall be paid to .the City of Anaheim in an amount
as determined by City Council resolution.
2. That a parking plan indicating compliance with City parking lot design
.standards shall be submitted to and approved by the City Traffic Engineer.
3. That the legal owner of subject property shall acquire a recorded
covenant granting an access easement from the legal. property owner
immediately east and west of subject. property for ingress and egress
purposes to subject. property. Said easement shall be designed in a
manner satisfactory to the City Traffic Engineer -and said covenant shall
be in a form satisfactory to the City Attorney. A copy of the recorded
covenant shall be submitted to the Zoning Division.
4. -That trash storage areas shall be provided in a manner acceptable to the
Street Maintenance and Sanitation Division and in accordance. with
approved. plans on file with said Division.
5. That subject property shall be developed substantially in accordance with
plans and specifications on file with the City of Anaheim marked Exhibit
Nos. 1, 2 and 3; provided, however, that approval is for either:
(a) A minimum of twenty five (25) parking spaces with all small car
.spaces being at least eight (8) feet wide; or
(b) A minimum of twenty. four (24) parking- spaces if the Street
Maintenance and Sanitation Division requires installation of a
.trash enclosure and with aII small car spaces being at Ieast B feet
wide.

6. That prior to commencement of the activity herein approved, or prior to
issuance of a building permit,. or within a period of one year from the
date of this decision, whichever occurs first, Condition Nos. 1, 2 and 3,
above-mentioned, shall be complied with. Extensions for further time to
complete said conditions may be granted in accordance with Section
18.03.090 of the Anaheim Municipal Code.
7. That prior to final building and zoning inspections, Condition Nos. 4 and
5, above-mentioned, shall be complied with.
