Resolution-ZA 1989-02• • DECISION AF THE ZONING ADMINISTRATOR - ZA 89-02 PETITION: VARIANCE N0. 3886 CEQA STATUS: CATEGORICAL EXEMPTION CLASS-5 DATE OF PUBLIC HEARING: December 29, 1988 OPPOSITION: No .one indicated their presence at the public hearing in opposition and no correspondence was received. OWNER: STEVE ALLEN, 2737 West Baylor Avenue, Anaheim, CA 92801 LOCATION: 2737 West Baylor Avenue REQUEST: Petitioner requests waiver of the following to construct a 745 square foot, 3-car garage: SECTIONS 18.12.060.050 - Minimum structural setback. 18.26.063.010 (25-foot front yard and 20 foot and 18.26.063.011 'front-on' garage setback required; 23 feet and 10 feet proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the request is minimal because the proposal is similar to existing setbacks on other nearby residential properties and that-four off-street parking spaces will be constructed to replace the ones being removed: three in the new garage and one in a new parking space 2. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 3. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of minimum structural setback to construct a 745 square-foot garage on a rectangularly-shaped parcel of land consisting of approximately 7,500 square feet located at the northwest corner of Baylor Avenue and .Colorado .Street, having frontages of approximately 75 feet on the north side of Baylor Avenue-and 100 feet on the west side of Colorado Street, and further described as 2737 West Baylor Avenue; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, ..Class 5, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. 0175g 1 ZA 89-02 .~ Page 2 Variance No. 3886 • • Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3886, subject to the following conditions: 1. That the existing driveway on Baylor Avenue shall be removed and replaced with standard curb, gutter, sidewalk and landscaping. 2. That roll-up garage doors shall be installed and maintained on the new 3-car garage. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked of Exhibit Nos. 1, 2 and 3. 4. That prior to final building and zoning inspections, Condition Nos. 1, 2 and 3, above-mentioned, shall be complied with. 5.
