ZA 89-14 PETITION: ADMINISTRATIVE ADJUSTMENT N0. 29 CEQA STATUS: CATEGORICAL EXEMPTION, CLASS 5 DATE NOTICES MAILED: March 1, 1989 REQUESTED BY: John and Pamela Boyle 1839 South Janette Lane, Anaheim, CA 92802 REQUEST: Waiver of the following to construct a room addition to an existing single family residence on property located at 1839 South Janette Lane: SECTIONS 18.12.080.D10 - Minimum sideyard setback. and 18.26.063.020 (5 feet required in the RS-7200 Zone; 4 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and having been duly noticed and no'written objections having been. received, I do hereby find, pursuant to Section 18.12.080: 1. That the the proposal is minimal because it consists of a deviance of less than-20~ from the minimum. required sideyard setback (20~ permitted; 20~ proposed) as permitted under Code Section 18.12.080.010; 2. That no written opposition was received during the required 10-day notification period; 3. That there. are special circumstances applicable to the property such as size, shape, topography,. location or surroundings,. which do not apply to other identically zoned properties in the vicinity; and 4. That strict application of the :Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the .vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of the minimum sideyard setback to construct a room addition to an existing single family residence on property located at 1839 .South Janette Lane; and that the Planning Director or his authorized representative has.. determined that the proposed project falls within the definition of Categorical Exemptions,-Class 5, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based. on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 29, subject to the property being developed substantially in accordance with .plans and specifications on file with the City of Anaheim Marked Exhibit.
