OWNER: LOCATION: REQUEST: WILLIAM and MARY SNOW 148 Leandro Street, Anaheim, CA 92807 7480 Hummingbird Circle Petitioner requests waiver of the following under authority of Code Section 18.12.060.040 to construct a 2-story, 29-foot, 4-inch high, single-family residence: Section 18.84.042.011 Maximum structural height. (25 feet permitted in Scenic Corridor Overlay Zone; 27.5 feet high ridgeline and 29-foot, 4-inch high chimneys) Having been appointed Zoning`Admnistrator by the Planning Director, pursuant to Anaheim Municipal Code'. Section 18.12.040, to-..decide the above-referenced peti ion and a public hearing 'having been duly noticed for' and held-. on the ~ date set forth above, I do hereby find: 1. That the requested heights are minimal, consisting of three chimneys at 29 feet,. 4 inches and two roof ridgelines` (14-foot .long at 27 feet, 6 inches high .and 24-foot long at 25 feet, 4 inches high), which heights are less than a'10~ deviance from Code; 2. That the proposal will have minimal view impact`.because the building site is on a ridgeline with -all visible existing homes. (except the immediate neighbors along Hummingbird Circle) being at either a substantially higher grade level than subject building pad (50 feet higher or more) or at a distance,. 1,000 to 1,700 feet away; 3. .That there are special circumstances applicable to the property. such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 4. That strict application of the Zoning Code. deprives the property.. of privileges enjoyed by .other properties in identcal'zonng:classification in the vicinity because variances for taller homes have been granted for several of the immediate neighboring houses along Hummingbrd'Crcle. _ CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed_theproposal for waiver of maximum structural height to construct a single family dwelling on an irregularly-shaped parcel of land consisting of approximately 0.6'6 acre, having a frontage 'of approximately ,57 feet on the easterly side of Hummingbird Circle, having a maximum depth of approximately 186 feet, being located approximately 1,100 feet north of the centerline of Bunting Court, and further described as 7480 Hummingbird Circle; and that the Planning Director or his authorized representative has determined that the proposed project falls .within the definition of Categorical Exemptions, 02618 1 ZA 89-27 ;~~..~ J Page 2 Variance No. 3940 • Class 5, as :.defined in the. State EIR, Guidelines and is, therefore, categorically e$empt from the requirement to prepare an EIR. Based on the svidence and testimony presented to me, I dohereby determine to approve: Variance No. 3940, subject to the following conditions: L That unless proof of exemption is submitted in compliance with City Council Resolution No. 85R-423, prior to issuance of a building permit, he appropriate major thoroughfare and bridge fee shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfare and Bridge Fee Program for the Foothill/Eastern Transportation Corridor, as approved by City Council Resolution No: 85R-423. 2. That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as established by City Council resolution. 3 That prior to issuance of a building .permit, sewer assessment fees shall be 'paid to the City of Anaheim in .an' amount as determined by the City Engineer.. 4. That subject ,property shall be developed ,substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit :Nos. 1 through 5. 5. That prior to final building and zoning-inspections,; Condition No. 4, above-mentioned,. shall be complied with. 6. That ,'approval of this application .constitutes approval of .the proposed request only to -the extent that it complies' with the Anaheim Municipal Zoning_Code and any other applicable City regulations. Approval does-not include any ..action or findings as to compliance or approval of the request' regarding any, other applicable ordinance, regulation or requirement.....
