DECISION OF THE ZONING ADMINISTRATOR - ZA 89-29

REQUEST: Petitioner requests waiver of the following under authority of
Code Section 18.12.060.030 to establish a 4 lot industrial
subdivision:
Section 18.01.130 - Required lot frontage.
(frontage on a public street or alley
required; 3 lots with no frontage proposed)
Having been. appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:
1. That the request. is minimal because appropriate.. reciprocal vehicular
access and utility easements will be provided between the proposed
parcels and Allec Street;
2. That there are special circumstances applicable to the property such as
size, shape, topography, location or surroundings, which do not apply to
.other identically zoned properties in the vicinity; and
3. That strict application of the Zoning Code deprives the property of
privileges enjoyed by other properties in identical zoning classification
in the vicinity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of required lot frontage to establish a
four lot industrial subdivision on an irregularly-shaped parcel of land
consisting of approximately 23 acres, having a frontage of approximately 175
on the west side of Allec Street, having a maximum depth of approximately 638
feet, being located approximately 618 feet north of the center line of
Cerritos Avenue, and further described as 1415, 1425,.1435 and 1445 South

Ailec Street; and does .hereby .approve the Negative. Declaration upon
findingthat she has considered the Negative Declaration .together with any
comments received during the public review process and further finding on the
basis of the initial study and any comments. received that there is no
substantial evidence that .the project will have a significant effect on the
environment.
Based on .the evidence and testimony presented to me, I do hereby determine to
approve. Variance No. 3943, subject to the following conditions:
1. That a fee shall be paid to the City of Anaheim for street lighting along
Allec Street in an amount as established by City Council resolution.
2. That. all. lots within .subject subdivision authorized by this resolution
shall be served by underground utilities.
3. That fire sprinklers shall be-installed as required by the City Fire
Department.
4, That a parcel map shall be submitted to and approved by the City of
Anaheim and then be recorded in the Office of the Orange County Recorder.
5. That drainage of subject property shall be disposed of in a manner
satisfactory to the City Engineer.
6. That water service shall be provided in a manner approved by the City
Water Engineering Division and the City Fire Department.
7. That water improvement.. drawings for firelines shall be reviewed and
approved by the Water Engineering Division.
8. That subject property shall be developed substantially in accordance with
plans and specifications on file with the .City of Anaheim marked .Exhibit
No. 1; provided, however, that a reciprocal access easement shall be
provided between the four proposed parcels and Allec Street.
S 9. That a minimum twenty (20) foot wide reciprocal access easement shall be
provided between the four proposed parcels and Allec Street.
10. That prior to .final parcel map approval or within a period of one (1)
year from the .date. of this decision, whichever occurs first, Condition
No. ,9, above-mentioned, shall be complied with. Extensions for further
time to complete said conditions may be granted in accordance with
Section 18..03.090 of the Anaheim Municipal Code.

11, That prior to issuance of a building permit, Condition Nos.. 1, 6 and 7,
above-mentioned,. shall be complied with. Extensions for further time to
complete said.. conditions may be granted in accordance- with Section
18.03.090 of the Anaheim Municipal Code.
12. That prior to final building. and zoning inspections, Condition Nos. 2, 3,
5 and 8, above-mentioned, shall be complied with.
13. That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City regulations. Approval does not
include any action or findings as to compliance or approval of the
request, regarding any.. other applicable ordinance, regulation or
requirement.
This decision is made,. signed, and entered into the file this eleventh day of
