RE: LARGE FAMILY DAY CARE HOME PERMIT NO. 89-02 - Zoning Administrator
Decision No. 89-35
Notice is hereby given that the Zoning Administrator for the City of Anaheim
has approved the above referenced permit application for a large family day
care home for a maximum of 12 children on property located at 2426 Transit
Avenue, Anaheim, California, subject to the following condition, the purpose
of which is to mitigate any noise impact of the proposed outdoor play area
which will be in the shallow (approximately 15-foot deep) rear yard:
That prior to commencement of the activity herein approved and subject to
obtaining the consent of the adjoining property owner to the south (2427
Mall Avenue, Assessor's Parcel No. 127-042-15), cement blocks shall be
added to the existing block wall along the south property line to bring
said fence to a height of six (6) feet as measured from the finished
grade of subject property. Said wall addition shall be of a design,
material and construction which is consistent with the existing block
wall. A copy of the plan(s) for said wall addition shall be submitted to
the Zoning Division and a permit shall be obtained from the Building
Division if required. If applicant cannot obtain such consent from the
adjoining property owner (in either written form or by verbal contact
with staff of the City Planning Department)., this condition shall be
considered null and void.
The authority and criteria for the approval of the large family day care home
permit is in Section 1597.46 of the California Health and Safety Codes and
Section 18.04.:140 of the Anaheim Municipal Code. According to Section 1597.46
the City shall issue a non-discretionary permit if the large family day care
standards set forth are met. These standards have been adopted by the City of
Anaheim and are set forth in Anaheim Municipal Code. Sections 18.01.070 and
18.-04.140 18..04.140.
The approval of this permit is based upon the following findings of fact:
1. That the use and building comply with the applicable site development
standards of the zone in which the property is located;
2. That the above condition to raise the wall height to 6 feet will mitigate
the noise impact of the outdoor play area on the. adjacent neighbor and
will bring the wall to a height which is typical for fences between
single-family residences; and

3. The use complies with all of the criteria and standards established for
such use pursuant to Section 1597.46 of the California Health and Safety
Codes and to the applicable provisions of the Anaheim Municipal Code.
Any .person aggrieved by the decision of the Zoning. Administrator may appeal
such decision to the City Council, tendering the applicable appeal fee to the
City Clerk's Office within twenty-two days following the date of this
decision. Said permit shall not be deemed final, and permittee shall not be
authorized to engage in the use .granted by said permit, until the expiration
of said twenty-two day appeal period.
