REQUESTt Petitioner requests waiver of the following under authority of
Code Section 18.12.060.OS0 to establish 2 RS-10,000 Zone lots:
SECTION 18.25.061.020 - Minimum lot width.
(90 feet required in the RS-10,000
zone.; 62.5 feet proposed for both. lots)
Having. been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:
1. That subject proposal is denied on the basis that there are no other
RS-10,000 zoned lots in the area with similar narrow lot widths (62.5
feet); that other area lots with nonconforming lot widths are
approximately 75-80 feet wide minimally;. that the proposal is a
significant deviance from the 90-foot lot width required by Code (the
proposal being approximately 30~ narrower than required):; and that
approval of subject waiver would result in a .proportionally greater
amount of :construction on subject property than if the property were
developed with one dwelling as permitted by Code and said construction
could, therefore, adversely impact adjacent existing 1-story dwellings;
2. That there are no special circumstances applicable to the property. such
as size, shape, topography, location or-surroundings, which do not apply
to other identically zoned properties in the vicinity; and
3. That strict application of the Zoning Code does not deprive the property
of privileges enjoyed by other properties in identical zoning
classification in the vicinity, all of which are zoned RS-.10,000.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of minimum lot width to establish two
RS-10,000 zoned lots on an irregularly-shaped parcel of land consisting of
approximately 0.6 acre, having a frontage of approximately 125 feet on the
south side of Westmont Drive, having a maximum depth of approximately 190
feet, being located approximately 125 feet east of the centerline of
Brenthaven'Place and further ..described as 1320 Westmont Drive; and does hereby
approve the Negative Declaration upon finding that she has considered the
Negative. Declaration together with any comments received during the public
review process and further finding on the basis of the initial study and any
comments received that there is no substantial evidence that the project will
have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
deny Variance No. 3965.
This decision is made, signed, and entered into the file this twentieth day of
June, 1989.

NOTICE.: This. decision shall become final unless an appeal to the City
Council, in writing, ,accompanied by .an appeal fee, is filed with the City
Clerk within 15 days of the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said
15 days.
