Resolution-ZA 1989-48~~ (.. • • DECISION OF THE .ZONING ADMINISTRATOR - ZA 89-48 PETITION: VARIANCE NO. 3967 CEQA STATUS: CATEGORICAL EXEMPTION CLASS 5 DATE OF PUBLIC HEARING: June 29, 1989 OPPOSITION: No one indicated their presence at the public hearing in opposition, and no correspondence in opposition was received. OWNERS: DOUGLAS BLACK and VERONIQUE BLACK 4958 East Budlong Street, Anaheim, CA 92807 LOCATION: 4958 EAST BUDLONG STREET REQUEST: Petitioner proposes waiver of the following under authority of Code Sections 18.12.060.060 and 18.12.060.070 to construct a 196 sq.ft. room .addition to an existing single-family residence: (A) SECTION 18.27.062.020 - 'Maximum lot coverage. (35~ coverage permitted; 37~ proposed) (B) SECTLON 18.27.062.021 - Maximum number of bedrooms. (3 bedrooms permitted on a 5,000 sq.ft. lot; 4 bedrooms, as proposed, require a minimum 5,850 sq.ft. lot) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Sectom 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed- for and held on the date set forth above, I do hereby find: 1. That the request is minimal because subject property. has an exceptionally large back yard (about 1,639 _sq.ft.) which, even. after the addition (196 sq.ft:) is constructed, will be larger than is typical for a large RS-5,000 zoned back yard (about .1,250 sq.ft.) and, therefore, a substantial ,amount of private on-site open space will remain available for recreational purposes; and that .other nearby back yards are shallower, being about 15 feet deep which is similar to the proposal; 2. That there are special circumstances applicable o the property such as size, shape., topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 3. That .strict application of the Zoning Code. deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT .FINDING: That the Zoning Administrator has reviewed the proposal for waiver of maximum site coverage and maximum number of bedrooms to cons ruct a 196 sq.ft. room addition to an existing single-family residence on a rectangularly-shaped parcel of land consisting of 0312g 1 ZA 89-48 ~ ~~ A- Page 2 Variance No. 3967 approximately 5,000 sq.ft., having a frontage of .approximately 50 feet on the south side. of Budlong .Street, having a maximum depth of approximately 100 feet, being located approximately 100 feet west of the centerline of Cymbal Way, and further described as 4958 East Budlong Street; and that the Planning Director or his. authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 5, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3967, subject to the following conditions: 1: That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2 and 3. 2. That prior to final building and zoning inspections, Condition No. 1, above-mentioned, shall be complied with. 3.
