OWNERS: JAMES ARRYNS and SHEREE ARRYNS 331 South Ohio Street, Anaheim, California 92805 LOCATION: 331 SOUTH OHIO STREET REQUEST: Petitioner requests waiver of the following under authority of Code .Section 18.12.060.110 to construct a -1,110 sq.ft. second floor addition to an existing single-family residence: SECTIONS 18,06.050.011 - Minimum number and type of parkina 18.06.080 ~vaces. and_18.26.066r010 (4 'spaces required: minimum 2 in a garage and 2 on a minimum 16-foot wide driveway; ~~ spaces proposed: 1 in the .garage and in the 10-foot wide driveway) ~~ Having been appointed Zoning Administrator bg the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public -hearing having been duly noticed .for and held on the date set forth above, I do hereby find:. 1. .That. the request is minimal because .the proposed construction consists of expanding an `existing single-family. residence by adding a second story, and that on-site parking spaces are available for 5 vehicles: 1 in the garage, and 4 in the 85-foot long driveway; 2. That the variance will .not cause an increase in, traffic congestion in the immediate vicinity nor adversely affect any adjoining land-uses; and 3. That the granting of the variance under the, conditions imposed, if any, wily not be detrimental to the peace., health, safety or general welfare of the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY .ACT FINDINGS .That the Zoning Administrator has reviewed the proposal for .waiver of minimum number and type of parking spaces to :construct a 1,110 sq.ft. second floor addition to an existing single-family residence on a rectangularly.-shaped parcel consisting of approximately. 0.1.2 acre, having a frontage of approximately 50 .feet on the west side of -0ho Street, having a maximum depth of approximately 1TO feet, being located approximately 390 feet south of the centerline of Broadway .and further described as 331 South -Ohio Street;. and that the Planning Director or his authorized representative has determined that the proposed project falls ..within-"the definition of Categorical Exemptions,. Class 3 as defined in-the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. 0317g 1 ZA 89-51 `... Page 2 Variance No. 397 1 Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3971, subject to the following conditions: 1. That a fee shall be paid to the City of Anaheim. for street lighting along Ohio Street in an .amount as established by City Council resolution. 2. That the legal owner of subject property shall irrevocably offer to dedicate to the City of Anaheim a strip of land ten (10) feet in width from the centerline of the alley along the west property line for alley widening purposes. 3. That sidewalks shall be repaired along Ohio- Street as required by the City Engineer. and in accordance with standard plans and .specifications on file in the Office of the City Engineer. 4. That subject property shall ,be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos:.. 1, 2 and 3. 5. That prior to issuance of ,a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 1 and 2, above-mentioned, shall be complied with. Extensions .for further time to complete said conditions may be granted in: accordance with Section 18.03.090 of the Anaheim Municipal Code. 6. That prior to final building and zoning inspections, Condition' Nos. 3 and 4 above-mentioned, shall be complied with. 7. That. approval. of this. application constitutes approval of the proposed request only to the extent that it complies with the Anaheim .Municipal Zoning Code and any other applicable City regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement..
