REQUESTS Petitioner requests waiver of the following under authority of
Code Section. 18.12.06D.050 to construct a 2-unit, 2-story
multiple-family building .and expand one existing single-family
.structure:

Having .been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section' 18.12.040, -to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:.
1. That no other front yards in the surrounding residential area are paved,
and .that approval of the request would have an adverse impact on the said
residential area because the proposal is to pave almost the entire front
yard for 2,parking spaces thereby leaving less than 15~ of said yard (144
sq.ft.) for landscaping (in comparison to about 70~ for a typical front..
yard);
2. That large nearby areas were .recently (June 14, 1988) down-zoned .from
RM-1200 "Medium Density Residential" to RM-2400 "Low-medium Density
Residential" (thereby reducing the maximum potential area density by
one-half} in an-effort to protect the existing lower. density development
.from the adverse impacts of higher densities ( uch as more people,.
heavier traffic volumes and more vehicles parked in the public street);,
3. That subject property is the same size (8,060 sq.ft.) and shape (52 feet
wide by l55 feet deep rectangle) and has the same public street and .alley
access as all the other lots in the area and, therefore, there are no
special circumstances applicable to the property, such as size, shape,
topography, location. or surroundings, which do no apply to other
identically zoned properties in the vicinity; and

4. That no similar°waivers have been granted in the area and, therefore,
strict application of the Zoning Code does not deprive the property of
privileges enjoyed by .other properties in identical zoning classification
in the vicinity.
CALIFORNIA. ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of permitted encroachment .into front
setback to construct a 2-unit, 2-story multiple-family building. and expand one
existing single.-family structure on a rectangularly-shaped parcel. of land
consisting of approximately-0.18 acre, having a frontage of approximately 52
feet on the east side of Philadelphia Street, having a maximum depth of
approximately. 155 .feet, being located approximately 182 feet south of .the
centerline of La Palma Street and further described as 746 North Philadelphia
Street; and does hereby approve the Negative Declaration upon finding that she
has considered the Negative Declaration together with any comments received
during the public review ..process. and further finding on the basis of the
initial study and` any comments received that there is no substantial evidence
that the project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
deny Variance No. 3972.
This decision is made, signed, and entered into the file this seventeenth day
of July, 1989.`

NOTICE; This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 davs of the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said
