REQUEST: To retain an existing room addition at 944 North Helena Street with
waiver of the following under authority of Code Section 18.12.080:
Section 18.26.063.020 - Minimum side~ard setback.
(5 feet required; 4 feet proposed
DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning-Administrator by the Planning Director to decide
the above-referenced: Administrative Adjustment, and subject administrative
adjustment having been duly noticed and no written: objections having been
received, I do hereby find, pursuant to Section 18.12.080:
1. That. he request-is minimal amounting to a 1-foot (20~) deviance from
Code, that subject proposal is an extension of the pre-existing dwelling
which is located at the.same 4=foot setback, and that the underlying
property width is legally nonconforming'{being only 45 feet wide instead
of 70 feet as required by Code) and.. the subject'`setback deviance from
Code (20~) is significantly.-smaller than the lot width deviance (36~);
2. That no written opposition was received during the 10-day required
notification period;
3. That there are special circumstances applicable' to the property such as
size, shape, topography, location or surroundings, which do not apply to
other identically .zoned properties in the vicinity; and
`4. That strict application of the Zoning Code _deprives the property of
privileges enjoyed by other properties in identical zoning .classification.
in the vicinity.
CALIFORNIA ENVIRONMENTAL OUALTTY ACT -FINDING: That the Zoning Administrator
has reviewed the proposal .for waiver of minimum side yard setback to retain. an
.existing room addition at-944 North `Helena Street; and that the Planning
Director or his authorized representative has determined that the proposed
project"falls: within the definition of Categorical, Exemptions, Class 5, as'
defined in 'the State EIR-Guidelines and is,.therefore, categorically .exempt
from the requirement-to prepare an EIR.
Based on the evidence ,presented to me, I do hereby. determine to grant
Administrative Adjustment No. 36, subject to the property being developed
substantially, in accordance with plans on file. with the City of Anaheim
labeled Exhibit No: 1.

NOTICE: This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 days of the 'date of the .signing of this decision or unless
members of the City Council shall request to review this decision within said
15 days.
