Eastman, 944 North Helena, Anaheim, CA 92805 REQUEST: To retain an existing room addition at 944 North Helena Street with waiver of the following under authority of Code Section 18.12.080: Section 18.26.063.020 - Minimum side~ard setback. (5 feet required; 4 feet proposed DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning-Administrator by the Planning Director to decide the above-referenced: Administrative Adjustment, and subject administrative adjustment having been duly noticed and no written: objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That. he request-is minimal amounting to a 1-foot (20~) deviance from Code, that subject proposal is an extension of the pre-existing dwelling which is located at the.same 4=foot setback, and that the underlying property width is legally nonconforming'{being only 45 feet wide instead of 70 feet as required by Code) and.. the subject'`setback deviance from Code (20~) is significantly.-smaller than the lot width deviance (36~); 2. That no written opposition was received during the 10-day required notification period; 3. That there are special circumstances applicable' to the property such as size, shape, topography, location or surroundings, which do not apply to other identically .zoned properties in the vicinity; and `4. That strict application of the Zoning Code _deprives the property of privileges enjoyed by other properties in identical zoning .classification. in the vicinity. CALIFORNIA ENVIRONMENTAL OUALTTY ACT -FINDING: That the Zoning Administrator has reviewed the proposal .for waiver of minimum side yard setback to retain. an .existing room addition at-944 North `Helena Street; and that the Planning Director or his authorized representative has determined that the proposed project"falls: within the definition of Categorical, Exemptions, Class 5, as' defined in 'the State EIR-Guidelines and is,.therefore, categorically .exempt from the requirement-to prepare an EIR. Based on the evidence ,presented to me, I do hereby. determine to grant Administrative Adjustment No. 36, subject to the property being developed substantially, in accordance with plans on file. with the City of Anaheim labeled Exhibit No: 1.
