REQUEST:... Petitioner proposes waivers of-the following under authority of
Code Section 18.12.060.010 to construct a 295 sq.ft. family-room
addition to an existing single-.family residence:
(a) SECTION 18.27.062.020 - Maximum site coverage.
(35~ permitted; 40~ proposed)
(b) SECTION 18.27.062.021 - Maximum number of bedrooms and
minimum open space.
(3 bedrooms on a 5,000 sq.ft.
permitted; 4 bedrooms proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim .Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for. and held on the
date set forth above, I do hereby find:.
1. That waiver (a) is minimal because the number of rooms is not actually
being increased (the proposed family room is an expansion/continuation of
the dining room) and useable recreational open space is available
elsewhere 'on the lot in that the front yard is 25 feet deep (minimum
10-feet permitted) and a good-sized open. area (24 feet by 26 feet) will
remain in the rear yard (minimum 10,-foot depth permitted);.
2. That waiver (b) is "technical" in nature because the fourth "bedroom" is
actually a second floor study which was converted from a "bonus" room
after subject house -was originally sold and before petitioner purchased
the house, and that- the new family room is actually an
expansion/continuation of the dining room;
3. That there are special circumstances .applicable. to the groperty such as
size, shape, topography, location or surroundings, which do not apply to
other identically zoned properties in the vicinity; and
4. That strict .application of the Zoning Code deprives the property of
.privileges enjoyed by other .properties in identical .zoning classification
in the vicinity.

CALIFORNIA ENVIRONMENTAL QUALITY ACT .FINDING: That the Zoning Administrator
..has reviewed the proposal for -waivers of (a) maximum site coverage,-and (b)
maximum number of bedrooms and minimum open space to construct a 295 sq.ft.
family room addition to a single-family house on a rectangularly-shaped parcel
of -land consisting of approximately 5,000 sq.ft., having a frontage of
approximately 50 feet on the west side of Avenida Pina, having a maximum depth
of 100 feet, being located approximately 130 feet north of the centerline of
Camino Correr and further described as 171 North Avenida Pina; and that the
Planning Director or his authorized representative has determined that the
proposed .project falls within the definition of Categorical Exemptions, Class
5, as defined in the State EIR Guidelines and is, therefore, categorically
exempt from the requirement to prepare an EIR.
Based. on the evidence and testimony presented to me, I do hereby determine to
approve Variance No. 3980, subject to the following conditions:
1. That subject property shall be developed substantially in .accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. T and 2.
2. That prior to final-.building. and zoning .inspections, Condition No. 1,
above-mentioned, shall becompliedwith..
3. That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City regulations. Approval does
not include any action or findings as_ to compliance or approval of the
request. regarding any other applicable ordinance, regulation or
requirement.
