(35~ permitted; 37.7 proposed) Having .been appointed Zoning Administrator"by the Planning Director, pursuant to Anaheim Municipal-Code: Section: 18.12.040, to decide the above-referenced .petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That during,'the 10-day period following the mailing of the notice of petition for.: subject administrative adjustment {proposing a deviance of less than l0~ from the maximum permitted"site coverage), one letter in opposition was 'received; that the petitioner then submitted the necessary additional :information and paid the ;fee. for a public hearing; and that a public .hearing was scheduled for August 24, 1989; 2. That the request is minimal-amounting to a a deviance of Tess. than 8~ from the permitted lot coverage (or 158 sq.ft. more than the 2047 sq.ft. coverage permitted by Code);. 3. That adjacent residences will not be impacted by the 1-story proposal because; the existing. 29-foot rear yard. setback will be maintained (10 feet being the minimum permitted by-Code), the 'side yard setback adjacent to 'the proposed addition will be 5 feet (the minimum permitted by Code) for the 22-foot length of said addition with the remaining 33-foot side - yard being. greater than 8 feet, the roof line of the addition will be a continuation of the existing roof line of subject residence, and the addition will enlarge the existing family room/dining room because a wall between-the two areas will be entirely removed; 4: That.. there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 5.. That. strict application of the Zoning Code deprives the property of privileges enjoyed by other grogerties in identical zoning classification in the vicinity. 0350g 1 ZA 89-58 -, ~= Page 2 Administrative .Adjustment No. 32 (Public Hearing) CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed -the-.proposal to construct a room addition to an existing single-family residence with waiver of maximum site coverage on a rectangularly-shaped parcel of land consisting of approximately 5,850 sq.ft., having a frontage of approximately 53 feet on the east side of Mosswood Drive, having a maximum depth of approximately 109 feet, being located approximately 200 feet north of the centerline of Woodsboro Avenue and further described as 1240 North Mosswood Drive; and that the Planning Director or his authorized representative has. determined that the proposed project. falls within the definition of Categorical. Exemptions, Class 5, as defined in the State EIR Guidelines 'and is, therefore, categorically exempt from the requirement to prepare an EIR.. Based on the evidence and testimony presented to me, I do hereby determine to approve Administrative Adjustment. No. 32, following the public hearing and .subject to the following conditions 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the -petitioner and which are on file with the City marked Exhibit No. 1. 2. That prior to final building and zoning inspections, Condition No. 1, above-mentioned, shall be complied with. 3. That approval of this application constitutes approval of the proposed request .only to the extent that it complies. with the Anaheim Municipal Zoning Code and .any .other applicable .City, State and Federal regulations... Approval does .not include any action or findings as to compliance or ,approval of the request regarding any other applicable ordinance, regulation or requirement.
