REQUEST: Waiver of the following under authority. of Section 18.12.080.020 to
construct a single-family residence at 7707 Autry Drive:
SECTIONS 18.01.090 - Maximum structural. height.
18.23.A62.0201 (32-foot-nonhabitable architectural
and 18.84.042.0202.a embellishment.. which- .includes a 2-foot
crawl space under-house permitted in the
Scenic Corridor Zone Overlay;
33-foot tower which includes a 3-foot
crawl--space proposed)
DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide
the .above-referenced Administrative Adjustment,. and having been .duly noticed
and no written objections having been received, I do hereby find, pursuant to
Section 18.12.080:
1. That the proposal consists of a tower over the foyer (having an area which
is 10~ of the total roof area, as permitted by Code), which tower is 33
feet high overall because of a 3 foot crawl. space underneath instead of 2
feet as permitted by Code, resulting in a tower which is 1-foot {3~)
higher than permitted by Code;
2. That the proposed 3~ deviance is minimal, being less than half of the 10~
.permitted by Code in connection with approval of an Administrative
Adjustment;
3. That there will be a very minimal impact by subject proposal on any
neighboring houses because the grades of the closest houses are either
lower (about l0 feet lower to the north) or higher (more than 15 feet
higher to the south) than the. grade of subject property, and that. the
houses to the east. and west are located significantly further than 100
feet away and are at grades which are 10 feet or higher than the grade of
subject property;
4. That no written opposition was received during the required 10-day public
notification period;

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That .the Zoning Administrator
has reviewed the proposal to construct a single-family residence with waiver
of maximum structural height at 7707 Autry Drive; and that the Planning
Director or` his authorized representative has determined that the proposed
project falls within the definition of Categorical Exemptions, Class 5, as
defined in the State EIR ,Guidelines and is, therefore, categorically exempt
from the requirement to prepare an EIR.
Based on the evidence presented to me, I do hereby determine to grant
Administrative Adjustment No. 0039, subject to the property being developed
substantially in accordance with plans and specifications submitted to the
City of Anaheim by the petitioner and which plans are on file with the City
marked Exhibit Nos. 1 through 7.
This .decision is made, signed, and entered into the file this fourteenth day
of September, 1989.

Clerk within- TS-days of the date of the signing of this decision or unless
