Resolution-ZA 1990-04~.~~~ DECISION OF THE ZONING ADMINISTRATOR - NO ZA 90-4 ADMINISTRATIVE ADJUSTMENT N0. 42 CEQA STATUS: CATEGORICAL EXEMPTION - CLASS 5 DATE NOTICES MAILEDs December 29, 1989 REQUESTED BY: David Kan P.O. Box 18282, Anaheim, CA 92817 REQUEST: Waiver of the following under authority of Section 18.12.080.010 to construct a single-family residence at 5100 East Copa De Oro Drive: Section 18.23.063.030 - Minimum rear yard setback. (2 feet required; 20 feet 6 inches proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoninq Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject .Administrative adjustment having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the proposed administrative adjustment deviates from Code by 18~ and a maximum of 20~ deviance is permitted; 2. That there are special circumstances applicable to the property which is irregularly-shaped with a very long frontage along Copa de .Oro Drive, and that said frontage .consists of the .entire northerly and westerly property lines of subject lot; and 3. That no written opposition was received during the required notification period. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning .Administrator has reviewed the proposal for waiver of minimum rear yard setback to construct a single-family residence at 5100 East Copa De Oro Drive; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical. Exemptions, Class 5, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 42, subject to the following condition: 1.
