REQUEST: Petitioner requests waiver of the following under authority of Code
.Section 18.12.060.110 to°establish an outdoor storage area for an
existing industrial warehouse:

Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:
1. That this variance is granted based on testimony presented during the
-public hearing specifying that there will be a maximum of 15 employees
on-site at any one time and that the work shifts are staggered with
one-half hour gaps between the end of one shift and the start of the next
shift;
2. That this variance is further granted on the basis of the parking. analysis
(contained in a letter dated September 4, 1990) which was found to be
adequate by the City Traffic Engineer for the specific combination of
.proposed uses (in connection with a business to manufacture refuse
containers):
Office 2,720 sq.ft.
Industrial 11,247 sq.ft.
Outdoor storage 4,352 sq.ft.
3. That the need for the parking variance is based upon a proposed outdoor
storage area .which can easily be converted back to parking spaces if the
need arises;

4. That the variance will not cause an increase in traffic congestion in the
immediate vicinity nor adversely .affect any adjoining land uses; and
5. That the granting of the, variance under the conditions imposed will not be
detrimental to the. peace, health, safety or general welfare of the citizens
of the City of Anaheim.
.CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal-for waiver of the minimum number of parking spaces to
establish an outdoor storage area for an existing industrial warehouse; and
that the Planning Director or his authorized representative has determined that
the proposed project falls .within the definition of Categorical Exemptions,
Class 11, as defined in the State EIR Guidelines and is, therefore,
.categorically exempt from the requirement to prepare an EIR.
Based. on the evidence and testimony presented to me, I do hereby determine to
approve. Variance No. 4087, subject to the following conditions:
1. * That trash storage areas shall be refurbished to the satisfaction of the
Street Maintenance and Sanitation Division to comply with approved plans
on file with said division.
2. * That plans shall be submitted to:the City Traffic Engineer for his review
and=approval showing conformance with the latest revision of Engineering
Standard Plan Nos. 436 and 602 pertaining to parking standards. Subject
property. shall thereupon be developed and maintained in conformance with
said .plans.
3. That all driveways be reconstructed to accommodate fifteen (15) foot
radius curb returns in conformance with Engineering Department Standards.
4. That no parking areas, as shown on the submitted plan, shall be fenced for
use as outdoor storage..
5. That in order to vary the parking .demand, work shifts-shall be as
follows: 6:30 a.m. to 2.:00 p.m., 2:30 p.m. to 10:00 p.m. and 10:30 p.m.
to 6:00 a.m., Monday through Friday.
6. (a) That all loading and unloading shall take place on-site in the
.designated area{s) and shall not take place. in any fire lanes or the
public streets.;
(b) That none of the required parking areas shall be used for loading or
unloading;
7. .That-the legal owner of subject property shall acquire a recorded
unsubordinated covenant granting an access easement from the legal
property owner immediately north and west of subject property for ingress
and egress purposes to subject property. Said easement shall be designed
in a manner satisfactory to the City_Traffic Engineer and said covenant
shall be in a form satisfactory to the City Attorney. A copy of the
recorded covenant shall be submitted to the Zoning Division.

8. That subject property shall be developed substantially in accordance with
.plans and specifications submitted to the City of Anaheim by the
petitioner and which plans are on file with the Planning Department marked
Exhibit Nos. 1.
9. That the outdoor storage area shall be enclosed by a minimum twelve (12)
foot high chain link .fence interwoven with redwood slats (except along the
.east side where the building is located) to fully screen all storage,
loading and unloading activities from adjacent streets and properties.
10. That within a period of one hundred eighty (180) days from the date of
this decision, Condition Nos. 1, 2, 3, 7, 8 and 9, above-mentioned, shall
be complied with. Extensions for further time to complete said conditions
may be granted in accordance with Section 18.03.090 of the Anaheim
Municipal Code.
11. That all employee shall be directed to park on-site in designated parking
spaces.
12.* That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal regulations.
Approval does 'not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance,
regulation or requirement. .Conditions marked with an asterisk.(*) are
required by established laws, codes, regulations and agreements and are,
therefore, not subject to negotiation.

NOTICE: This decision shall become final unless an appeal to the City Council,
in writing, accompanied by an appeal fee, is filed with the City Clerk within
15 days of the date of the signing of this decision or_unless members of the
City Council shall request to review this decision within said 15 days.
DECLARATION OF SERVICE BY MAIL: I do hereby declare under penalty of perjury
that on the date set forth below, I did deposit, in the United States Mail, a
