REQUEST: Petitioner requests waiver of the following to establish an outdoor storage-area under authority of Code Section 18.06.080: Section 18.06.050:0212 - Minimum number of narking spaces. 18.06.050t031 (66 required; 39 existing) 18.06.050.033 and 18.61.066.050 Having been appointed Zoning Administrator by the Planning Director, pursuant to .Anaheim Municipal Code Section 18.12.040,, to decide the above-referenced .petition and a public hearing having been duly, noticed for and held on the date set forth above, I do herebg find: 1. That the City Traffic Engineer has concurred with the parking demand study contained in a letter dated. September 6, 1990, and identifying the number of employees and work hour shifts; 2. That the request is minimal because of the specific manufacturing business involved (roto-injection),,the minimal number of employees (relative to the size of -the actual building and outdoor storage area.):, .and that if the business tenant changes, the outdoor storage area .can be converted into parking spaces in accordance with Code standards; 3. The parking variance is granted for the following specific uses: Manufacturing 1,920 sq.ft. Office 23,.280 sq.ft. Outdoor storage 15,,600 sq.ft. That this variance will not cause an increase in traffic congestion in the immediate .vicinity nor adversely affect-ang adjoining land uses; and 5. That the granting of this variance under the conditions imposed, if any, will not be detrimental to the peace, health, safety or general welfare of .the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING:. That the Zoning Administrator has reviewed the proposal for waiver of minimum number of parking spaces to establish an outdoor storage area in connection with an industrial building.on an irregularly-shaped parcel of land consisting of approximately 3.3 acres, having; an approximate frontage of 538 feet on the west side of Jefferson Street, having a maximum depth of approximately 330 feet, being located approximately 270-feet south of the centerline of Miraloma Avenue, and 'further described as 1251 North-Jefferson Street; and-does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the; public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4090, subject to the following conditions: 1. *-That prior'to issuance of `a building permit,; the appropriate traffic signal assessment fee shall be paid to she City of Anaheim in an amount as established by-City Council resolution. 2.-* That plans shall'be submitted to the City Traffic Engineer for his review and approval showing conformance with the latest revision of Engineering Standard Plan-Nos. 43.6.,..,602 and 607 pertaining to-parking standards. Subject property shall thereupon be developed and maintained in conformance with said plans. 3. That all driveways shall be reconstructed to accommodate (15) foot radius curb returns in conformance with Engineering Department Standards. 4. That no required parking areas (as shown on the approved exhibit) shall be fenced foruse as outdoor storage. ,- 5. *-That trash storage areas shall be refurbished to the satisfaction of the Street Maintenance and Sanitaton_Divsion to comply with approved plans on file with said division. 6. That subject property shall be developed substantially in .accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. That prior to issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. l and 2, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 8. That prior to final building and zoning inspections, Condition Nos. 3, 5 and 6 above-mentioned, shall be complied with. 9. * That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal zoning Code and any other applicable City, State and Federal regulations. Approval does not. include. any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Conditions. marked with an asterisk (*) are required by established laws, codes, regulations and agreements and are, therefore, not subject_to negotiation.
