OPPOSITION: No one indicated their presence at the public hearing in
opposition to the proposal and no correspondence in opposition
was received.
REQUEST: Petitioner requests waiver of the following to construct a 13,800
sq.ft. foot industrial building:

Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and public hearing having been duly noticed for and held on the date
set forth above, I do hereby find:
1. That the parking analysis submitted by the petitioner and contained in a
letter dated October 3, 1990, was approved:. by the City Traffic Engineer for
the specific combination of land uses in both the existing and proposed
buildings which consist of the following:
Manufacturing and warehousing 77,542 sq.ft.
Offices 6,278 sq.ft.
Storage 10,800 sq.ft.
Total 94,620 sq.ft.
2. That on-site space is available if the need for additional parking arises
in the future.
3. That the variance will not cause an increase in traffic congestion in the
immediate vicinity nor adversely affect any adjoining land uses; and
4. That the granting of the variance under the conditions imposed will not be
detrimental to the peace, health, safety or general welfare of the citizens
of the City of Anaheim.

CALIFORNIA ENVIRONMENTAL OURLITY ACT FINDINGS: That the Zoning Administrator
has reviewed the proposal for waiver of minimum number of parking spaces to
construct a new 13,800 sq.ft. industrial building on an irregularly-shaped
parcel of land consisting of approximately 5.1 acres, having a frontage of
approximately 440 feet on the northwest side of Grove Street, having a maximum
depth of 300 feet, being located approximately 950-feet north of the centerline
of La Palma Avenue, and further described as 1177 North Grove Street; and does
hereby approve the Negative Declaration upon finding that she has considered
the Negative Declaration together with any comments received during the public
review process and further finding on the basis of the initial study and any
comments. received that there is no substantial evidence that the project will
have a significant effect on the environment.
Based on the .evidence and testimony presented to me, I do hereby determine to
approve Variance No. 4099, subject to the following conditions:
1. * That the new construction authorized by this resolution shall be served
by underground utilities.
2. * That the legal owner of subject property shall dedicate to the City of
Anaheim an easement five (5) feet in .width along the west property line
for public utility purposes..:
3. That the legal owner of subject property shall maintain a minimum twelve
(12) foot separation between any portion of the building and the high
voltage power lines that are adjacent to or across the subject property.
Any equipment used in the construction and maintenance of facilities
located on the subject property shall not be operated within ten (10}
feet of overhead high voltage power lines. Details and mitigations shall
be as required by City Electrical Engineering Division.
4. * That prior to issuance of a building permit, the appropriate traffic
signal. assessment fee shall be paid to .the City of Anaheim in an amount
as established by .City Council resolution.
5. That the existing driveway on Grove Street. shall be removed and replaced
with standard curb, gutter, sidewalk and landscaping.
6. * That plans shall be submitted to the City Traffic Engineer for his review
and approval showing conformance with the latest revisions of Engineering
Standard Plan Nos. 436, 602 and-605 pertaining to parking standards.
Subject property shall thereupon be developed. and maintained in
conformance with said plans..
7. That all driveways shall be constructed/reconstructed with fifteen (15)
foot radius curb returns as required by the City Engineer in conformance
with Engineering Standards.
8. That no outdoor storage areas shall be fenced-in to accommodate material
storage.
9. That the parking layout shall be modified to improve circulation as
required by the City Traffic Engineer.

10. That a-plan shall be provided to show loading space for trucks, as
required by Code.
11. * That-curbs gutters and driveways shall be repaired along Grove Street as
required by the City. Engineer and in accordance with standard plans and
specifications on file in the Office of the City Engineer.
12. * That prior to commencement of structural framing, fire hydrants shall be
installed and charged as required and approved by the Fire Department.
13. * That an adequate, unobstructed fire truck turn-around area shall be
specifically shown on plans submitted for building permits, as required
by the ;Fire Department. Said turn-around area shall be permanently•
marked and maintained to the satisfaction of said Department.
14. That subject property shall be developed substantially in accordance with
plans and specifications submitted to the City of Anaheim by the
petitioner and which plans are on file with the Planning Department
marked Exhibit Nos. 1 and 2 .
15. That prior to issuance of a building permit or within a period of one (1)
year from the date of this decision, whichever occurs first, Condition
Nos. 2, 4, 6, 9, 10 and 13, above-mentioned,, shall be complied. with..
Extensions for further time to complete said conditions may be granted in
.accordance with Section 18.03.090 of the Anaheim Municipal Code.
16. That prior to final building and zoning inspections, Condition Nos. 3, 5,
6, 7, 11 and 14, above-mentioned, shall be complied with.
17. * That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal
regulations.. Approval does not include any action or findings as to
compliance or approval of the request regarding any other applicable
ordinance, regulation or requirement. Conditions marked with an asterisk
(*) are required by established laws, codes, regulations and agreements
and are, therefore, not subject to negotiation.
This decision is made, signed, and entered into the file this sixth day of
