ZA 90-113 PETITION: VARIANCE NO. 4101 CEQA STATUS: Categorical Exemption, Class 3 DATE OF PUBLIC HEARING:.-November 29, 1990 OWNER: HILL WILLIAMS DEVELOPMENT 175 Riverview Drive #200, Anaheim, CA 92808 AGENT: FRANK GONZALES & ASSOCIATES 1336 Chapman Avenue, Orange, CA 92666 LOCATION: 350 South Hidden Grove Lane and 6260 East Fox Glen Drive SUPPORT: One letter was received in support of the proposal. OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposed and that no correspondence in opposition was received. REQUEST: Petitioner requests waiver of the following under authority of Section 18.12.060.040 to construct-two (2) single family structures: SECTIONS 18.23.062:0201 -' Maximum structural height. and 18.84.042.010 (25 feet permitted; 33 feet proposed) Having-been appointed Zoning Administrator by the Planning Director,,,,pursuant to Anaheim Municipal Code Section 18..12..040, to decide the above-referenced petition and public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That there are special circumstances applicable to the property consisting of topography, location and surroundings, which do not apply to other identically zoned properties in the vicinity because the maximum .heights of the two dwellings will be either at the same elevation or no more than 3 feet higher than the elevations of the property lines separating subject .property from adjacent residential lots to the south, and that no views from adjacent properties are adversely impacted because the lines-of-sight will be over the proposed dwellings; and 2. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity because adjacent homes to the south have north-facing elevations which exceed 25 feet in height. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS• That the Zoning Administrator has reviewed the. proposal for waiver of maximum .structural height to construct 2 single-family structures on an irregularly-shaped parcel of land consisting of approximately 2.27 acres located at the southeast corner of Hidden Grove Lane and Fox Glen Drive, having approximate frontages of 500 feet an the .east side of Hidden Grove Lane and 115 on the south side of Fox Glen Drive, and further ZA-4101 -1- ZA 90-113 • • Variance No.4101 Page 2 described as 350 South Hidden Grove Lane and 6260 East Fox Glen Drive; and that the Planning Director or his authorized. representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 3,_as defined in the State of California Environmental Impact Report (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to approved Variance No. 4101, subject to the following conditions: 1. * That, unless proof of exemption is submitted in compliance with City Council Resolution No. 85R-423 prior to issuance of a building permit, the appropriate major thoroughfare and bridge fee shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfare and Bridge Fee Program for the Foothill/Eastern Transportation Corridor, as established by City Council resolution. 2. * That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as established by City Council resolution. 3. * That the appropriate fee shall be paid to the City of Anaheim for Santa Ana Canyon Road widening purposes,. in an amount as established by City Council Resolution. 4. That the front-on driveway dimensions shall be as follows: ...Tilt-up garage doors - minimum of sixteen (16) feet wide and twenty five (25) feet long, or Roll-up :garage doors - minimum sixteen (16) feet wide and twenty (20) feet long The specific garage doors shall be shown on plans submitted for building permits, and said doors shall be installed. and maintained as shown on submitted plans, 5. That subject property shall be developed substantially in;,accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked .Exhibit Nos. 1, 2, 3A, 4A, 5A, 6A, 7A, 3B, 4B, 5B and 6B. 6. That prior to issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 1, 2, 3 and 4, above-mentioned, shall be complied with. Extensions for further. time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 7. That. prior to .final building and zoning inspections, Condition Nos. 4 and 5, above-mentioned, shall be complied with.... Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Conditions marked with an asterisk (*) are required by established laws, codes, regulations and agreements and are, therefore, not subject to negotiation.
