OWNER; NABIL ARIF 801 South Priscilla Street, Anaheim, CA 92806 LOCATION:. 801 South Priscilla Street REQUEST: Waiver of .the .following under authority of Code Section 18.12.060.070 and 18.12.060.010 to construct a second story addition to an existing single-family residence: (a) SECTION 18.27.062.031 - Maximum site coverage. (35~ permitted; 41~ proposed) (b) SECTION 18.27.062.031 - Maximum number of bedrooms and open mace required. {b,850... sq,ft. lot .required for 4 bedroom dwelling; existing 5,000 sq.ft. lot for proposed 4 bedrooms) Having been appointed Zoninq Administrator by .the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the requested waiver (a) is minimal because the lot. contains a "0-side yard" on the south .with usable open space in excess of what is typically be available in RS-5000 tracts; specifically, the open space .consists of a minimum 10-foot wide side yard to the north and a full 25-foot deep rear yard. 2. That approval of the requested waiver (b) is consistent with existing development in the area because the underlying Tot is similar to other neighboring lots in the same tract which were. developed- with 4-bedroom houses on 5,000 sq.ft. lots prior to the .Code .amendment which established the current ratio of maximum number of .bedrooms to minimum Sot size; and, therefore, strict application of the Zoning Code would deprive subject property of privileges enjoyed by other properties in identical zoning classification in the vicinity. 3. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 04478 1 ZA 90-15 y ~.."' Page 2 Variance No. 4034 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waivers_of maximum lot coverage and open space requirements to construct a second story addition. to an existing single residence; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions,. Class 5, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4034, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which are on rile with the city marked Exhibit Nos. Z, 2, and_3. 2. That prior to final building- and zoning inspections, Condition No. 1, .above-mentioned,- shall.be complied with. 3.* That approval of this application constitutes approval of the proposed request-only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State, and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
