AMENDING DECISION N0. 89-72, NUNC PRO TUNC

WHEREAS, Thee Zoning Administrator signed Decision No. ZA 89-72
on December 21, 1989, granting Administrative .Adjustment No. 04I for waiver of
minimum number of parking spaces to permit a nail shop in an existing
commercial building and including the following Condition No. 2:~,
"That within a period of ninety (90) days from the date .herein, the
petitioner shall .file for an amendment to Variance No. ~i2874 to modify
Condition No. 11 therof (pertaining to limiting use of the property to
those. commercial uses which have parking requirements which do not .exceed
the available number of parking spaces)." ',
WHEREAS, Variance No. 2874 was approved by the City Council on
April 19, 1977, in connection with Resolution No. 77R-271 and included a
condition .pertaining to all uses on ,the site having parking demands consistent
with the number of available parking spaces.
WHEREAS, Condition No. 2 of .Zoning Administrator Decision No.
89-72 was, by inadvertence, incorrectly worded because the 'I,actual parking
demand for 'the specific use (1 space) is consistent with'I the number of
available parking spaces although it is less than the Code requirement (4.6
spaces); that there was no expressed opposition to the proposed parking
waiver.; .and, therefore, the nai shop use plus related"parking demand conforms
with the conditions of approval of'Variance No. 2874.
THEREFORE, Condition: No. 2 of Decision No. 89-72 is hereby
amended in its entirety to read as follows:
"That approval of this this administrative adjustment is specifically for
a nail shop use., as shown on the approved plans, unless it 'is shown that a
different commercial use ...would have the same or'a lower parking demand."
This decision is made, signed and entered into the file this'. twenty-seventh

Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 davs of the .date of the signing of this decision or unless
members of the City Council shall request to review this decision within said
15 days.
