Resolution-ZA 1990-19• • DECISION OF THE ZONING ADMINISTRATOR - ZA 90-19 PETITION: VARIANCE N0. 4038 'CEQA STATUS: CATEGORICAL EXEMPTION - CLASS 11 DATE, OF PUBLIC HEARING: April 5, 1990 OPPOSITION:- No one indicated their presence in opposition at the public hearing; two interested people indicated their presence; and no correspondence in opposition was received. OWNER: REORGANIZED CHURCH OF LATTER DAY SAINTS 393 South Tustin Street, Orange, CA 92666 AGENT: SHIMOZONO & ASSOCIATES 1920 East Katella Avenue, Suite 5, Orange CA 92667 - LOCATION: 827 South Walnut Street REQUEST: Petitioner requests waiver of" the following under authority of Code Section 18.12.060.010 to replace the existing identification sign for a church facility: :SECTIONS 18.05:080.030 - Permitted identification sign. and 18.21.067.020 (One 20 soft. sign permitted in the RS-A-43,000 Zone; one 24 sq.ft. - monument-type sign proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal .Code. Section 18.12.040, to decide the above-referenced petition and a public .hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the proposal is minimal, consisting of a 4-foot high monument sign, the area of which exceeds Code by only 4 sq.ft.; 2. That there are special circumstances applicable to the property such as .:size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the. vicinity; and 3. That strict. application. of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the. vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of maximum size of identification sign to replace the. existing identification sign 'for a_church. facility located on a rectangularly-shaped parcel of land consi ting of approximately 0.7.6 acre located at the southwest :corner of Chateau Avenue and Walnut Street, having frontages of approximately 300 feet on the south side of Chateau-Avenue and 110 feet on the west side of Walnut Street, and further, described as 827 South Walnut Street; and that the Planning Director or his authorized. representative has determined that -the proposed project falls: within the definition of ..Categorical Exemptions, Class ll, as defined in the -State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. 0460g 1 ZA 90-19 • ~ Page 2 Variance No. 4038 Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4038, subject to the following conditions: 1. That a covenant, in the form approved by the City Attorney's Office, shall be recorded .with the Office of the Orange County Recorder stipulating that the proposed .sign will be relocated at the property owners' expense and at no cost to the City of Anaheim at such time as Walnut Street is widened to its ultimate location. 2. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and .which plans are on .file with the Planning Department marked Exhibit Nos. 1 and 2. 3. That prior to commencement of the activity authorized by this decision or within a period of one (1) year from the date of this decision; whichever occurs first,. Condition No. 1, above-mentioned, shall be complied with. Extensions for further .time to complete said conditions may be granted in accordance with Section 18.03.090 of-the Anaheim Municipal Code. 4. That prior to final building and zoning inspections, .Condition No. 2, -above-mentioned, shall be complied with. 5. That ,approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable.. City, State and Federal regulations. Approval does not include any. action or findings as to compliance or approval of the request .regarding any other applicable ordinance,..regulationor requirement.
