CEQA STATUS: CATEGORICAL EXEMPTION CLASS 1 DATE OF PUBLIC HEARING: May 3, 1990 OPPOSITION:> No one indicated them presence in opposition at the public hearing; and no ,correspondence in opposition was received. HUNDLEY, 2318 South Vineyard, Ontario, CA 917b1 LOCATION: 1255 North Grove Street REQUEST: ..Petitioner requests a waiver of the following under authority of-Code Section. 18.12.060 ..110 to establish an outdoor storage area for an existing industrial warehouse: SECTIONS 18.06.050.031 - Minimum number of parking spaces. 18.06.050.033 (24 required; 5 proposed} I8.06.080 and 18.61.066.050 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced .petition and a`public hearing having been duly noticed far and held on the date set forth above,' I do hereby find: 1. That subject variance is granted on the basis that the outdoor storage area can readily be re-converted taparking usage when said storage yard ceases; and, further, on the basis of the parking study (.titled Parking Analysis for Fairway Transport at 1255 N. Grove Street.and dated March 5, 1990) which was approved by the City Traffic Engineer for this specific proposal which has a maximum of 3 employees with no drive-in customers and consisting of the following combination of uses: Use Floor Area (sq.ft.) Code requirement # spaces .Office 7.50 @ 4 spaces/1,000 sq.ft. = 3 Warehouse 7.,876 @ 2.25 spaces/1,000 sq.ft. = 18 Outdoor storage 7.,300. @ 1 space/2,500 sq.ft. _ 3 Total number required - 24 2. That. subject variance is granted for the same time period as remains on petitioner's {Fairway Transport Inc.J lease which expires August l,` 1991, provided that it ..the petitioner .wishes to extend this variance, additional periods of time may be requested in connection with a duly noticed public hearing; 3. That the petitioner stipulated at the public hearing to repairing and re-slatting the damaged fence and gate facing Grove Street; 4. That the variance will not cause an increase in traffic congestion in the immediate vicinity. nor adversely affect any adjoining land uses; and 5. That the granting of the variance .under the conditions imposed, if any, will not be detrimental to the :peace, health, safety or general welfare of the citiaens of the City of Anaheim. 0471q -1- ZA 90-22 .7 ~ ~ Page 2 Variance No. 4045 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGz That ,the Zoning Administrator has reviewed .the proposal for waiver of minimum number of parking spaces to establish an outdoor storage area for an .existing industrial warehouse; and that the Planning Director or his authorized. representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 1, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on he evidence and testimony presented to me, I do hereby determine to approve Variance No. 4045, subject to the following conditions: 1. * That any lockable pedestrian and/or vehicular access gates shall be equipped with "knox box" devices as required and approved by the Fire Department. 2.' That .subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file vrith the Planning Department marked Exhibit Nos. 1 and 2. 3: That within a period of sixty (60) days from the date this decision, the damaged fence and gate facing Grove Street shall"be repaired and re-slatted, to more ;adequately screen the outdoor ;storage from the public's .view. 4. That this variance shall terminate on August Z, 1991; provided,. however, that addition periods of time may be requested by the petitioner and may be approved in connection with a duly noticed public hearing.. Each .such time extension(s) shall not exceed the additional term of the property lease or a maximum of two (2) years, whichever is less. 5. * That approval of this application constitutes•.approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include .any action or findings as:to compliance or approval of the request regarding -any other applicable ordinance, regulation or requirement. Further, conditions marked with an asterisk (*) are required by established laws, codes, regulations and/or agreements and are. are not subject to negotiation.
