Resolution-ZA 1990-31~. r DECISION OF THE ZONING ADMINISTRATOR - ZA 90-31 PETITION: CONDITIONAL USE PERMIT N0. 3276 CEQA STATUS: NEGATIVE DECLARATION HEARING DATES: May 31, 1990, continued to June 14, 1990 OPPOSITION: There were 4 people indicating their presence in opposition to subject request at the May 31, 1990, hearing; 1 person spoke in opposition at the June 14, 1990, hearing; and a petition containing 56 signatures in opposition was received. OWNER: HWA JA RAH 2207 West Woodley Avenue, Anaheim, CA 92801 LOCATION: 2207 and 2211 West Woodley Avenue REQUEST: Petitioner .requests approval of a conditional use permit under authority of Code Sections 18.12.050.040 and 18.26.050.020 to permit a child care facility for 30 children in the RS-7200 "Residential,. Single-Family" Zone. Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced .petition, pursuant to Anaheim Municipal Code Section 18.12.020, and a public hearing having been duly noticed for and held on the date :set forth above, I do hereby find, pursuant to the Sections 18.02.030.030 through 18.02.030.035 of the Anaheim Municipal Code: 1. That-the proposed use is hereby approved for a period of one (1) year with possible time extensions in connection .with a duly noticed public hearing, at which time it shall be determined whether the business and related parking activities (including. dropping-off and picking-up children). have had an adverse affect on the surrounding neighborhood; 2. That the proposed use is properly. one for which a conditional use permit is authorized by the Zoning Code; 3. That the proposed use, as granted, will. not adversely affect the adjoining land uses and the growth and development of the area in which is is proposed to be located; 4. That the size and shape of the site for the proposed use, as granted, is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare; 5. That the traffic generated by the .proposed. use., as granted with limitations on parking activities (including dropping-off and picking-up children), will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area;. and 6. That the granting of the conditional use permit under the conditions imposed will not be detrimental. to the peach, health, safety and general welfare of the citizens of the City of Anaheim. 0497g 1 ZA 90-31 ~~ i • Conditional Use Permit No. 3276 Page 2 CALIFORNIA ENVIRONMENTAL OUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for a child care facility for 30 children in the RS-7200 {Residential, Single-Family) Zone on a rectangularly-shaped parcel of land consisting of approximately 0.45 acre, having a frontage of approximately 140 feet on the. north side of Woodley Avenue, having a maximum depth of approximately 108 feet, being located approximately 75 feet west of the centerline of Brookhurst Street and further described as 2207 and 2211 West Woodley Avenue; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration _together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approved Conditional Use Permit No. 3276, subject to the following conditions: 1. * That the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as established by City Council. resolution. 2. That a "loop" on-site drop-off and pick-up area shall be provided at 2211 West Woodley Avenue (the westerly lot of subject property) to discourage drivers from backing their vehicles onto Woodley Avenue. Said area shall minimally include: (a) Painted lines on the pavement outlining the entire drop-off/pick-up lane; (b) Painted arrows on the pavement.indicating "enter" and "exit" to prohibit drivers from backing their vehicles onto Woodley Avenue; {c) Sign(s), in both English and Korean,. stating that drivers dropping-off children must stop and/or park. their vehicles on-site and that children shall -note be dropped-off or picked-up from cars stopped or parked in Woodley Avenue; and (d) Landscaped planter pots located. parallel to Woodley Avenue inside the curve of the "loop" drop-off lane to further discourage drivers from backing their vehicles onto. Woodley. 3. * That sidewalks shall be repaired along Woodley Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 4. That a local fire alarm system shall. be provided. 5. * That street lighting facilities along Woodley Avenue shall be installed as required by the Utilities General Manager in accordance with specifications on file in the Office of the Utilities General Manager; or that security in the form of a bond, certificate of deposit, letter of -credit, or cash:, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements:. .Said security shall be posted with the City of Anaheim prior to issuance of a building permit. The above required improvements shall be installed prior to occupancy. 6. * That trash storage areas. shall be provided and maintained in a location acceptable to .the Street Maintenance and Sanitation Division and in 0497g 2 ZA 90-31 .. • Conditional Use Permit No. 3276 Page 3 accordance with approved plans on file with said Division. A plan sheet including solid waste storage and collection is required for this project. Such information shall be specifically shown on the plans submitted for .building .permits. 7. That all longer term parking .(other than vehicles being used to drop-off or pick-up children) shall take place in the following locations: (a) In the driveway at 2207 West Woodley Avenue; and/or (b) Behind the florist shop at the northwest corner of Woodley Avenue and Brookhurst Street; and/or (c) In no more than. two (2) clearly striped parking spaces at 2211 West Woodley as shown on Exhibit No. 1 (site plan). 8. That subject property shall be developed substantially in accordance with plans and specifications submitted to the .City of Anaheim by the petitioner and which plans are on file with the City marked Revision No. 1 of Exhibit No. 1 and Exhibit Nos. 2 through 7; including the requirements specified in Condition No. 2, above. 9. That the operators of subject child care facility shall :inform, in writing, all parents and other adults dropping-off and picking-up children that the cars dropping-off and picking-up children :shall enter the drop-off area at 2211 West Woodley Avenue (as described in Condition No. 2, above) and that vehicles shall not back onto Woodley Avenue from said address at any time. 10. .That prior to issuance of a building permit or prior to commencement of the activity authorized by`this decision, whichever occurs first, Condition Nos. 1, 5 and 6, above-mentioned,-shall be complied with. Extensions for further time to complete said conditions- may be .granted in -accordance with Section 18.03-.09.0 of the Anaheim Municipal Code. 11. That prior to final building and zoning inspections or .prior to commencement of the .activity authorized. by thin ..decision, whichever occurs first, Condition Nos. 2, 3, 4, 5 and 8, above-mentioned, shall be_complied with. 12. That subject conditional use permit, is approved for a period of one (1) year; :provided, however,. that-additional. periods of time may be sought upon written request by the petitioner in connection with a duly-noticed public hearing. Approval of such extension will include consideration as to whether this use has had an adverse impact on the surrounding neighborhood (for instance: are children being dropped-off and picked-up from vehicles stopped or parked on the.. lot at 2211 West Woodley Avenue, as required; are such vehicles being backed into Woodley Avenue or are-such vehicles stopping in Woodley Avenue, thereby adversely impacting passing street traffic; etc.). 13. * That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval ...does not include any :action or findings as to compliance or approval of the request regarding 'any other applicable ordinance, regulation or requirement.
