E..s.' D. JOHNSON PROPERTY - (F-5.3.-.54-9)I Mr. Sam Collins, Attorney representing
E. Do 3ohnson Company, addressed the Council, referring to the pending
litigation in the Courts regarding access to the property and advising
that the Building Department was holding up the final release of their
project because they are unable to construct the curbs and gutters. He
further advised that the City is holding a $600000 cash deposit for said
improvements and requested that the Council authorize final release so
that the utilities can be connected.. Mro Collins presented photographs
of the area, showing accesses to the property, and suggested a meeting
with the Council to try and work out an agreement on the matters pending
in litigation; that in his opinion, to compel them to put in attractive
landscaping should not be offensive to anyone°
The Council indicated their willingness to discuss the matter
further with Mr° Collins and requested.that he retain the photographs
presented, for ~urther consideration at said time.
Councilman Coons moved that it be the finding of the Council
that the E. D. 3ohnson Company, by virtue of having posted a $600.00 cash
deposit, has , in essence, complied with the section of the Building Code
that requires the installation of curbs, gutters and sidewalks prior to
the final notice of completion, and that having so done, that they should
be considered to be completed, and that the 9as and lights can be furnished
to the building. Councilman Chandler seconded the motion. MOTION CARRIED.
