Resolution-ZA 1990-35,, ~ • DECISION OF THE ZONING ADMINISTRATOR - ZA 90-35 PETITION: VARIANCE NO. 4047 CEQA STATUS: CATEGORICAL EXEMPTIQN CLASS 11 DATE OF .PUBLIC HEARING: June 28, 1990 OPPOSITION: No ;one indicated their presence at the public hearing in opposition to the re-advertised and revised proposal; and no correspondence in opposition was received. OWNER: JOHN STEVENS 1570 West Katella Avenue, CA 92802 LOCATION: 1570 West Katella Avenue REQUEST Petitioner requests waiver of the following under authority of Code Section 18.12.060.030 to permit 5 wall signs: SECTIONS 18.05.065.010 - Permitted wall signs. and 18.44.067, {Maximum one 8 sq.ft. freestanding or wall sign permitted; five wall. signs ranking from 3 to 21 sq.ft. proposed) Having been appointed Zoning..Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to .decide the above-referenced petition and a public. hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That subject variance was originally approved by the Zoning Administrator on June 6, 1990, under Decision No. 90-28 to permit the following four signs: construction of one 39 sq.ft. monument sign and one neon wall sign facing north and retention-of two signs on canvass window awnings facing east and west; that the petitioner has requested revision to said approved signage to allow 5 wall signs instead; and that subject variance has been duly re-advertised to consider amendment to the original request and to the appropriate conditions. of approval; 2. That the revised proposal is_ as follows: to retain four existing wall signs (2 signs on the canvass. window awnings facing .east .and west and 2 neon signs in the windows underneath said awnings) and to construct one new 21 sq.ft. neon sign on the north-facing building wall; and 3. -.That the proposed revision reduces the total amount of approved sign display areas by approximately 33~, from 70 sq.ft. to 47 sq.ft. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has-reviewed the proposal for waiver of permitted. wall signs to retain 4 existing wall signs and to construct one new wall sign; and that the Planning Director or his authorized representative has determined that the proposed revised project falls within the definition of Categorical Exemptions, Class ll, as defined in_the State. EIR Guidelines and is, therefore, categorically exempt from the requirement. to prepare an EIR. Based on the foregoing and on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4047, as revised, and to amend the conditions of approval in their entirety to read as follows: O506g 1 ZA 90-35 ~ .., • • 1. That the business signage on subject property shall be developed and maintained substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 4; and consisting of the following five {5) specific wall signs: a. One (1) sign on the canvass window awning facing west, being no larger than five (5) sq.ft. in size, having maximum six inch (6") high letters, and reading: "Mrs. Stevens 772-1221"; b. One (1) sign on the canvass window awning facing east, being no larger than five (5) sq.ft. in size, having maximum six inch (6") high letters, and reading "Office 772-1221"; c. One (l) neon sign in the window facing west underneath the awning, being no larger than ten (10) sq.ft. in size, having maximum nine inch (9") high letters, and reading: "Mrs. Stevens Palm Reader"; d. One (1) neon sign in the windows facing fast underneath the awning, being no larger than six (6) sq.ft. in size, having maximum five and one-half inch (5-1/2") and seven and one-half inch (7-1/2") high letters, and reading "Palm Reader Gard Reader"; and e. One (1) twenty ,one (21) sq.ft. neon sign on the north-facing building wall oriented towards Katella Avenue. 2. That the appropriate sign and/or electrical permits shall be obtained from the Building Division. 3. That. prior to final building and zoning .inspections,. or prior to installation of the new neon sign, or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 1 and 2, above-mentioned, shall be complied with. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
