ZA 90-43 ADMINISTRATIVB ADJUSTMENT N0. 44 DATE OF PUBLIC HEARING: May 17, 1990, and continued to the June 28, 1990, Zoning Administrator meeting. OPPOSITIONS There was no one indicating their presence in opposition at either public hearing; and one letter of opposition was received prior to the May 17, 1990, Zoning Administrator meeting. DETERMINATION OF THE ZONING ADMINISTRATOR Having .been appointed Zoning Administrator by the Planning Director to decide. the above=referenced Administrative Adjustment,. and subject petition having been duly noticed and no written objections 'having"been received, I do hereby find, pursuant to Section 18.12.080: 1. That the request is .minimal amounting to a deviance of only. 7`b from the '.Code requirement which is less than the maximum 10~ deviance permitted in connection with an administrative adjustment; and 2. That one letter in opposition was received during the required notification period and that subjectpetition was therefore advertised for a public hearing, and that said opposition subsequently. withdrew his opposition when he reviewed the development plans. CALIFORNIA 'ENVIRONMENTAL. QUALITY ACT_ FINDING: That the Zoning. Administrator has reviewed the proposal-for waiver ,of minimum number of parking spaces to convert-eighteen 2-room. suites of an-existing. 114 unit motel into 36 single units for a 132-unit total;' and 'that the Planning Director or his. authorized representative has. determined that' the proposed project falls within the definition of Categorical Exemptions, Class 1, as defined in the State EIR Guidelines and is, therefore, .categorically. exempt .:from the requirement to prepare an ..EIR. 0515g -I- ZA90-43 } ~. i, ~ • Administrative Adjustment No. 44 Page 2 Based on the' evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 44, subject to the following condition: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner. and which plans are on file with the Planning Department marked Exhibit Nos. 1.through 5.
