DECISION OF THE ZONING ADMINISTRATOR - ZA 90-47
PETITION; VARIANCE N0. 4066 CEQA STATUS: NEGATIVE DECLARATION
DATE. OF PUBLIC HEARING: July 12, 1990
SUPPORT: One person indicated his presence at the public hearing in favor
of the proposal.
OPPOSITION: No one indicated .their presence at the public hearing in
opposition; and no correspondence in opposition was received.

REQUEST: Petitioner requests waiver of .the following under authority of
Code Section 18.12.060.110 to construct a 9,302 sq.ft. office
addition inside an existing industrial building with waiver of
the .following:
SECTIONS 18.06.050.031 - Minimum number of parking spaces.
18.06.050.0212 (902 required; 598 existing)
18.06.080
and 18.61.066.050
Having been.-appointed Zoning Administrator by the Planning Director,`pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:
1. That this parking. variance is granted on the basis that the applicant
submitted a parking study., titled "Cycle Industries Anaheim Warehouse
Building - Parking Study".dated June 4, 1990, which study was determined
to be adequate by the City Traffic Engineer for the following specific
combination of uses on .subject. property:

And, further, that the proposed accessory offices in the existing
industrial building amount to only 7~ of the total floor area (27:,673
sq.ft. of a 379,019 sq.ft. building) and that the building was originally
developed. about 30 years ago as an industrial warehouse with .parking
provided in compliance with the standards in effect at that time;

2. That the parking variance will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect any adjoining
land uses; and
3. That the granting of the parking variance under the conditions imposed,
if any, will not be detrimental to the peace, health, safety or general
welfare of the citizens of the City of Anaheim.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of minimum number of parking spaces to
construct a 9,302 sq.ft. office addition inside an existing industrial
building on a rectangularly-shaped parcel of land consisting of approximately
15.4 .acres, having a frontage of approximately 1,170 feet on the north side of
Winston Road, having a maximum depth of approximately 630 feet, being located
approximately 255 west of the centerline. of State -College Boulevard and
further described as 1515 East Winston Road; and does hereby approve the
Negative Declaration upon finding that she has considered the Negative
Declaration together with any comments received during the ..public review
process and further finding on the basis of the initial study and any comments
received that there is no substantial evidence that the project will have a
significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
approve Variance No. 4066, subject to the following `.conditions:
1. * That prior to .issuance of a building permit, the appropriate traffic
signal .assessment fee shall be paid to he City of Anaheim in an amount
as established by City Council resolution.
2. That the vehicular access rights to Winston Road except at approved
access .points, shall be released and relinquished to the City of Anaheim.
3. * That gates shall not be installed across any driveway or private .street
in a manner. which may adversely affect vehicular .traffic in the adjacent
public street. Installation of any gates shall conform to Engineering
Standard Plan No. 402 and shall be subject to the review and approval of
the City Traffic Engineer prior to issuance of a building permit.
4. That :.the existing two existing driveways. on Winston Road, as shown on
Exhibit No. 1, shall be removed and replaced with standard curb, gutter,
sidewalk and landscaping.
5. That. the existing fence and gate on the westside o£ the warehouse be
removed.
6. That no .storage of equipment or material shall - be permitted in the
parking .area.
7. That-the existing metal building and materials shall. be removed from the
westside of the warehouse.

8. * That. a fee for street. lighting purposes shall be paid to the City of
Anaheim based on the length of street frontage along Winston Road in an
amount as established by City Council resolution.
9. * That subject proposal authorized by this resolution shall be served by
underground utilities.
10.* That trash storage areas shall be provided and maintained in a location
acceptable to the .Street Maintenance and Sanitation Division and in
accordance with approved plans on file with said division. Such
information shall be specifically shown on the .plans submitted for
building permits.
11. (a) That prior to commencement of .the activity authorized under this
resolution, or prior to issuance of a building permit, or within a
period of ninety (90) days from the date of this decision, whichever
occurs first, and if it is determined by the Planning Department
that the proposed parking waiver (:necessitated by the interior
conversion of existing industrial space to accessory offices [7.3~
of the total floor area]. for the same business) makes this proposal
subject to the provisions of Development Agreement No. 83-01 between
the City of Anaheim and .Anaheim 5tadium_Associates, then the legal
owner(s) of .subject property shall execute and record an
unsubordinated covenant in a form approved by the City Attorney's
Office wherein such owner(s) agree not to .contest the formation of
any assessment district(s) which may hereafter be formed pursuant to
the provisions of Development Agreement No. 83-01, which district(s)
could include such legal property owner's property. A copy of the
recorded covenant shall then be submitted to the Zoning Division.
OR
(b) If it is determined by the Planning Department that this proposal,
as described in the preceding paragraph, is not subject to the
provisions of Development Agreement No. 83-O1, then this condition
shall not be applicable.
12. That subject property shall be developed substantivally in accordance with
plans: and specifications submitted to the City of Anaheim by .the
petitioner and which plans are on file with the Planning Department
marked Exhibit Nos.. 1 and 2.
13. That prior to issuance of a building permit or within a period of one (1)
year from the date of this resolution, whichever ..occurs first, Condition
Nos. 1, 2, 8, 10 -and 11(a), above-mentioned, shall be complied with.
Extensions for further. time to complete said conditions may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
14. That prior to final building and zoning inspections, Condition Nos. 4, 5,
6, 7, 9 and 12, above-mentioned, shall be complied with.

15.* That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning, Code and any other applicable City, State and Federal
.regulations. Approval .does not include any action or findings as to
compliance or approval of the request regarding any other applicable
ordinance, regulation or requirement. Conditions marked with an asterisk
(*) are required by established laws, codes, regulations and agreements
and are, therefore, not subject to negotiation.
This decision is made, signed, and entered into the file this nineteenth day
