Having been appointed Zoning .Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section. 18.12.040, to decide the above-referenced
petition and a public hearing .having been duly noticed for and held on the
date set forth above, I do hereby find:
REQUEST: Petitioner requests waiver of the following under authority of
COde $eCtlOn 18.12.060.080 to establish a 2-lot subdivision of an
existing industrial parcel:
1. That subject request is minimal because public ingress and egress for
vehicular and pedestrian access and public utilities will be provided by a
32-foot wide easement from La Palma Avenue to Parcel No. 1, and by a 32 to
24-foot wide easement: across Parcel No. l to Parcel No. 2, in accordance
with City standards;
2. That there are .special circumstances applicable to the property such as
size, shape, topography, location or surroundings, which do not apply to
other identically zoned properties in the vicinity; and
CEQA STATUS: NEGATIVE DECLARATION.

3. That strict application of the Zoning Code deprives the property. of
privileges enjoyed by other .properties in identical zoning classification
in the vicinity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: .That .the Zoning Administrator
has reviewed the proposal for waiver of required lot frontage to establish a
2-lot subdivision of an .existing. industrial parcel which is the southerly
"land locked" 4.87 acres of an irregularly-shaped parcel of land consisting of
approximately 12.5 acres, said 12.5 acre .parcel having. a frontage of
approximately 458 feet on the south side of La Palma Avenue, having a maximum
depth of approximately 1,150 feet, being located approximately .2.50-feet west
of the center line of Miller Street and further described as 3360 East La
Palma Avenue; and does hereby approve the Negative Declaration upon finding

that she has considered the Negative Declaration together with any comments
received during the public review .process and further finding on the basis of
the .initial study and any comments received that there is no substantial
evidence that the project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to
approve Variance No. 4070, subject to the following .conditions:
1. That the legal owner of subject property shall adjust any existing and
proposed Public Utility Easements which are altered as a result of the
proposed subdivision.
2. That a private water system with separate water service for fire
protection and domestic water shall be provided.
3. -.That the water backflow equipment and any other large water system
equipment shall be installed to the satisfaction of the Water Utility
Division in either: (a) underground vaults or (b) outside of the street
setback area in a manner fully screened from all public streets and
alleys.
4. That each lot have its own domestic and fire service.
5. That a minimum twenty (20) foot wide easement for separate fire water
service for Parcel No. 2 shall be provided.
6. That ingress and egress for vehicular and pedestrian access and public
utilities shall be provided, as .required by the City Engineer in
.accordance with City standards.
7. That subject property shall be developed substantially in accordance with
plans and specifications submitted to the City of Anaheim by the
petitioner and which plans are on file with he Planning Department
marked Exhibit No. 1.
8. That prior to final parcel map ,approval or within a period of one (1)
.year from the date of this decision, whichever occurs first, Condition
Nos. l and 6, above-mentioned, shall be complied with.
9. That prior to final building and zoning inspections., Condition Nos, 2, 3,
4, 5 and 7, above-mentioned, shall be complied with.
10. That approval of this application constitutes approval of the proposed
request only. to the extent that it complies with the Anaheim Municipal
Zoning Code and ang other applicable City,. State and Federal
regulations. Approval does not include any action or findings as to
compliance or approval of the request regarding any other .applicable
ordinance, regulation or requirement.
