Jeannette 470 North Newport Boulevard, Newport Beach, CA 92663 REQUEST: Waiver of the following under authority of Code Section 18.12.080.020 to construct a 2-story, 9,590 sq.ft. single-family residence at 563 East Peralta Hi11s Drive: SECTION 18.84.042.010. - Maximum structural height. (25 feet permitted in the Scenic Corridor Overlay Zone; 26 feet 6 inches proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having 'been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above., L do hereby find: 1. That the request is minimal because the. maximum proposed building height is 26-1/2 feet {6~ higher than permitted by Code), and.. that the portions of the roof higher than 25 feet. consist of a 60-foot long ridgeline at 25-1/2 feet high, `and a 25-foot long ridgeline and a peaked roof at 26-1/2 feet high; 2. That ,the proposal complies with Code Section 38.12.040 which allows maximum dimensional deviations of no more. than l0~ of what is permitted by Code; and 3. That no written opposition was received during the required notification period. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal to construct a 2-story, 9,590 sq.ft. single-family residence with waiver of maximum structural height located at 563 East Peralta Hills Drive.; and that the Planning Director or his authorized representative has determined. that the proposed project falls within the definition of .Categorical Exemptions, Class 5, as defined. in the .State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 52, subject to the following condition: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning bepartment marked Exhibit Nos. l through 8; provided, however, that as shown on Exhibit Nos. 4 and 7,-the maximum building heights shall be limited to the following: North-south ridgeline (60 feet long): East-west ridgeline (25 feet long): Peaked roof: Chimneys: 0536g 1 Twenty five and one half (25.5) .feet Twenty .six and one half (26..5) feet Twenty six and one half (26.5) feet Twenty nine (29) feet ZA 90-52 .. • Administrative Adjustment No. 52 Page 2 This decision is made, signed, and entered into the file this nineteenth day of July, 1990.
