REQUEST: Petitioner request waiver of the following under authority of Code Section 18.12.060.030 to install a roof-mounted satellite dish: SECTION 18.84.062.032 - Prohibited roof-mounted equipment. (No .roof-mounted mounted satellite dishes permitted in commercial zones in the. Scenic Corridor Overlay; one. 6-foot diameter roof-mounted .satellite dish proposed in the CL[SC] Zone) Having been appointed Zoning Administrator. by the Planning Director, pursuant to Anaheim Municipal Code Section 18,12.040,. to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby .find: 1. That the proposal is approved on the basis that because of its revised location it will be fully screened from Santa Ana Canyon Road by the building mansard along the north and from Avenida de Margarita by existing equipment screening and parapets at the southwest. corner of the building and the trees in the setback along that. street; that it will not be visible from Imperial Highway because of the existing building configurations; and, further, that the dish and .the supporting structure wily be painted brown or dark beige to blend with the existing building and mansard colors; 2. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 3. That. strict.. application of .the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. 0541g 1 ZA 90-53 Page 2 Variance No. 4062 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of prohibited roof-mounted equipment to construct a roof-mounted satellite dish in the Scenic Corridor Overlay Zone on an irregularly-shaped parcel of land consisting of approximately 9.8 acres located at the southwest corner of .Santa Ana Canyon Road and Imperial Highway, having .approximate frontages of 698 feet on the south side of Santa Ana Canyon Road and 708 feet on the west side of Imperial Highway, having a maximum depth of approximately 745 feet and further described as 5560 East Santa Ana Canyon Road;. and that the Planning Director or his authorized representative has determined that the. proposed project falls within the definition of Categorical. Exemptions, Class 11, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to .approve Variance No. 4062, subject to the following conditions: 1. That the appropriate permits shall be obtained from the Building Division. 2. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the .petitioner and which plans are on -.file with the Planning. Department marked Revision No. 1 of Exhibit No. l consisting of a six (6) foot diameter satellite dish with an over-all height of four (4) feet, ten (10)' inches; provided, however, that the color of the dish and the "mounting blocks/bal ast" 'shall be as dark as .possible for instance, brown or dark beige). 3. That prior to final building and zoning inspections, Condition No. 1, .above-mentioned, shall be complied with. 3. That approval of this application. constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does 'not include any ;action or findings as to compliance or approval of the request. regarding any other applicable ordinance, regulation or requirement.
