DECISION OF THE ZONING ADMINISTRATOR.- ZA 90-59
PETITION: VARIANCE N0. 4078
CEQA STATUS: NEGATIVE DECLARATION
DATE OF PUBLIC HEARING: August 9, 1990
OPPOSITION: No one indicated their presence in opposition at the public
hearing and no correspondence was received.

LOCATION: 16.13 acres on the south side of Sanderson Avenue
REQUEST: Petitioner requests waiver of the following under authority of coae
Section 18.12.060.080 to establish a 5-lot subdivision of an
existing industrial parcel:
SECTION 18.01.130 - Required lot frontage.
(Frontage on a public street or alley
required; 3 lots with frontage on a private
easement proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the
date set forth above, I do hereby find:
1. That. the proposed waiver is granted on the basis that vehicular access,
in accordance with the standards of the Engineering Department and as
approved by the City Attorney, will be provided to. the parcels not having
frontage on a public street;
2. That there are special circumstances applicable to the property such as
size, shape, topography, location or surroundings, which do not apply to
other identically zoned properties in the vicinity; and
3. fihat strict application of the Zoning Code deprives the property o£
privileges enjoyed by other properties in identical zoning classification
in the vicinity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of required lot frontage to establish a
5-lot subdivision on an irregularly-shaped parcel of land consisting of
approximately 16.13 acres, having a frontage of approximately 760 feet on the
south side of Sanderson Avenue at the southerly terminus of Auto Center Drive,
and having a maximum depth of approximately 1240 feet;. and does hereby approve
the Negative Declaration upon finding that she has considered the Negative
Declaration together with any comments received during the public review
process and further finding on the basis of the initial. study and any comments
received .that there is no substantial evidence that the project will have a
significant effect on the environment.

Based on the evidence and testimony presented to me, I do hereby determine to
approve Variance No. 4078, subject to the following conditions:
1. * That the legal owner of subject property shall dedicate to the City of
Anaheim an easement five (5) feet in width across Parcel No. 2 for public
utility purposes.
2.* That all .lots within subject subdivision authorized by this resolution
shall be served by underground utilities.
3.* That prior to issuance of a building permit, the appropriate fees due for
primary water mains and fire protection service shall be paid to the
Water Engineering. Division in accordance with Rules 15A and 20 of the
Water Utility Rates, Rules and Regulations.
4.* That grading and drainage of subject property shall conform to Chapter
17.04 "Grading, Excavations, Fills and Water Courses" of the Anaheim
Municipal Code.
5. That vehicular access shall be provided to each of the parcels not having
public street frontage in a design and location which complies. with the
appropriate Engineering Department standards. and as approved by the City
Attorney.
6: That subject property shall be developed substantially in accordance with
plans and specifications submitted to the City of Anaheim by the
petitioner and which plans are on file with the Planning Department
marked Exhibit No. 1, including. provision of vehicular access as
specified in Condition No. 5, above...
7. That prior to approval of a final parcel map or within a period of one
(1) year from the date of this decision, whichever occurs first,
Condition Nos. 1 and 5, above-mentioned, sha1l`be complied with.
8. That prior to issuance of a building .permit, Condition No. 3,
above-mentioned, shall be .complied with. Extensions for further time to
.complete said conditions may be .granted in accordance with Section
18.03.090 of .the Anaheim Municipal Code..
9. That prior to final building and zoning inspections, Condition Nos. 2, 4
and 6, above-mentioned, shall be complied with.
10.* That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal
regulations. Approval does not include any action or findings as to
compliance. or approval of the request regarding any other applicable.
ordinance, regulation or requirement. Conditions marked with an asterisk
(*) are required ,by established laws, codes, regulations-and agreements
and. are, therefore, not subject to negotiation.

NOTICE: This decision shall become final unless an appeal to the City
Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 days of the date of the signing of this decision or unless
members of the .City Council shall request to review this decision within said
15 days.
