REQUEST: Petitioner requests waiver. of the following under authority of Code Section 18.12.060.050 to construct a 296 sq.ft. freestanding sign with an electronic reader board: {a) .Sections 18.04.045.015 - Required structural setback. 18.05.098.011 (minimum 50 feet required from and 18.61.067 .Anaheim Boulevard for sign exceeding 100 aq.ft. in size; l0 feet proposed for a 296 sq.ft. sign) (b) Section 18.05.098 - Permitted sians. (Marquee or changeable copy sign not permitted; one electronic reader board (changeable convl sign proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That there are no special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity because the Santa Ana Freeway is directly across the street and subject property is very visible to traffic along the freeway; 2. .That strict application of the Zoning Code does not deprive the property of privileges enjoyed by other properties in identical zoning classification in the vicinity because neighboring buildings in the same industrial zone have signage in accordance with Code and, further, that the proposed sign is more than twice as large as permitted by Code; and 3. .That approval of this variance would establish an undesirable precedent and may encourage other similar requests. yyi .. v • Page 2 Variance No. 4081 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of required structural setback and permitted signs on an irregularly-shaped parcel of land consisting of approximately 1.1 acres located at the northwest corner of Anaheim Boulevard and Stanford Court, having approximate frontages of 182 feet on the west side of Anaheim Boulevard and 175 feet on the north side of Stanford Court, and further described as 1990 South Anaheim Boulevard; and that the Planning Director. or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 11, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to deny Variance No.4081.
