REQUESTz Petitioner requests waiver of the following under authority of Code
Section 18.12.060.050 to construct a two-car garage and second story
room addition:

and 18.34.020.010 (minimum 5 feet required; 1 foot proposed)
.Having-been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
'petition and a public hearing having been duly noticed for and held on the date
set forth above,'I do hereby find:
1. That there are special circumstances applicable to the property consistin

of shape, location and surroundings, which do not apply to other
identically zoned properties in the vicinity because subject property is
irregularly-shaped .having a very narrow street frontage (about 23 feet)
with the Carbon Creek Channel cutting at an angle through the property
across the front and the south side property lines thereby restricting the
:development potential;. and
That the side yard waiver pertains to the south side along the Carbon Creek
Channel and, therefore, no neighbors will be impacted by the proposed
1-foot side yard and, further,'no lines-of-sight along the street and/or
any driveway are adversely impacted.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for .waiver of required side yard to construct a
garage and second story room addition on an irregulary-shaped parcel of land
consisting of approximately 0.14 acre, having a frontage of approximately 23
feet on the west side of Stinson Street, having a maximum depth of
approximately 127 feet, being located approximately 420 feet south of the
centerline `of Lincoln Avenue and further described as 127 South Stinson Road;
and that the Planning-Director or his authorized representative has determined
that the proposed project falls within the definition of Categorical
Exemptions, Class 3, as defined in the State EIR Guidelines and is, therefore,
categorically exempt from the requirement to prepare an EIR.

.Based on the .evidence and testimony presented to me, I do hereby determine
to approve Variance No. 4082, subject to the following conditions:
1. That subject property shall be developed substantially in accordance
with plans and specifications submitted to the City of Anaheim by the
petitioner and which plans are on file with the Planning Department
marked Exhibit Nos. 1 and 2.
2. That prior to final building and zoning inspections, Condition Nos. 1,
above-mentioned, shall be complied with.
3. That approval of this application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal
regulations.
This decision is made, signed, and entered into the file this thirteenth
day of September, 1990.
