Resolution-ZA 1990-96 PETITION: DECISION OF THE ZONING ADMINISTRATOR - ZA 90-96 VARIANCE NO. 4079 CEQA STATUS: CATEGORICAL EXEMPTION - CLASS 5 DATE OF PUBLIC HEARING: .August 23, 1990 and re-advertised for the meeting of September 20, 1990 OPPOSITION: No one indicated their presence at either public hearing in opposition and one person indicated her presence in favor at the September 20, 1990 meeting; and 6 letters in favor were submitted at the September 20, 1990 meeting.. LOCATION: 1242 North Ralston Street REQUEST:" Petitioner requests waiver of the following to retain a 260 sq.ft. family room and convert required garage .parking to living area: (A) SECTIONS 18.12.060.050 - Minimum-structural setback. ,and 18.26.063.030 (10 foot rear-yard setback required; 38 inches existing) (B).SECTIONS.18.06.050.011' - Minimum number of parkina spaces. 18.06.080` (2 garage spaces required; 18.12:060.110 2 carport spaces in-tandem and 18.26.066.010 existing) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section. 18.12.040.,. to decide the above-referenced - petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby .find: 1. That-subject petition was originally ;.advertised .for public hearing on ..August 23, 1990, but, inadvertently and in error, the legal notice did not include both waivers, therefore, subject petition was correctly re-advertised for the .meeting of September 20,-1990; 2. That the requested waiver (A) is hereby granted on'the basis that there is a special circumstance applicable to the property consisting of the property being irregularly-shaped and having an exceptionally wide rear -property line (about 120 feet). in comparison to the`typical_lot width for the area (70 feet.),... resulting in the shallow setback area being minimal and .,.'pertaining to only 20 .feet of building length; 3. That the requested waiver (B) is hereby. granted on the basis-that more than 4 parking spaces (possibly as many as:6 or 8) are available entirely on-site because the driveway is large-and. can park 3 to 4 vehicles in addition to the spaces in the carport; ZA-4079R -1- ZA90-96 :G. • Page`2 Variance No. 4079 • 4. That the variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses;. and 5. That the granting of the variance under the conditions imposed, if any,-will not be detrimental to the peace, health, safety or general welfare of the-citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waivers of a minimum number of parking spaces-and a minimum structural setback to retain a 260 sq.ft. family room-and convert required garage parking to living area on an irregularly=shaped parcel of land consisting of approximately 0.17 acre, having a frontage of approximately 59 feet on the-east side of Ralston. Street, having a maximum depth of approximately 105 feet, being located approximately 535 feet north of the centerline of Romneya Drive and further described as 1242 North Ralston Street; .and that the Planning Director or his authorized representative has determined that the proposed project falls ..within the definition of Categorical Exemptions, 'Class 5, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR: Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4079, subject to .the following conditions: 1. That subject property shall be developed .substantially in accordance with plans and specifications submitted to•the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. 2. * That the existing carport structure near the south property line shall comply with the applicable standards of the City of Anaheim including. .the Uniform Building and Fire Codes as adopted by the City.. Appropriate permits shall be obtained for any necessary work.. 3. That prior to final building and zoning inspections, Condition. No, 1, above-mentioned, shall be complied with. 4. *.That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings. as to .compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Conditions marked with an asterisk (*) are required by established laws,-codes, regulations and agreements and are, therefore, not subject to negotiation.
