OWNER: EVI NAM KIM 201 North Via Cortez, Anaheim, CA 92807 LOCATION: 201 North Via Cortez REQUEST: Petitioner requests approval of a conditional use permit under authority of Code Section 18..12.050.060 to permit a ground-mounted satellite dish for.. an existing motel. Having been appointed Zoning Administrator. by the Planning Director to decide the above-referenced petition, pursuant to Anaheim Municipal Code Section 18.12.020, and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find,_pursuant to the Sections 18.02.030.030 through 18.02.030.035 of the Anaheim Municipal Code: 1. .That the proposed use (consisting of a dark-colored mesh-type satellite dish) is properly one;for which a conditional use permit is authorized by the Zoning Code; 2. That the proposed use will not adversely affect: the adjoining land uses of the area in which it is located because the satellite dish is not visible from the adjacent freeway which is approximately 25 feet, higher than the dish'and located on top of the adjacent slope, it is minimally visible from the cul-de-sac at the terminus of Via.Cortez because it is located approximately. 150 feet west of the street, and it will be minimally visible from the abutting property to the east because landscaping consisting of vines will be planted along the chainlnk fence which separates the two properties; _ 3. That the size and ;shape of the site for the proposed use is adequate to allow the full development of the proposed use. in a manner not detrimental to the particular area nor to-the peace, .health, safety and general welfare;-.and 4. .That the granting of the conditional use permit under the conditions imposed, if any, will not be detrimental to the peach, health, safety and general welfare of `the citizens of the City of Anaheim. ZA3335 -1- ZA 90-99 Conditional Use Permit No. 3335 Page"2 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal to permit a ground-mounted '..satellite dish for a hotel on an irregularly-shaped parcel of land. consisting of .approximately 2.8 acre, .having a frontage of approximately 86 feet on the west side of Via Cortez, having a maximum depth of approximately 608 feet, being located approximately 930 feet north of the centerline of Santa Ana Canyon Road, and further described as 201 North .Via Cortez; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical'Exemptions, Class 3, as defined in the State EIR Guidelines. and is, therefore, categorically .exempt from the requirement to prepare an EIR. Based. on the ..evidence and testimony presented tome, I do hereby.. determine to approved Conditional Use Permit No. 3335, subject to the following,conditiona: 1. That landscape plans shall bs submitted showing the satellite screened from view from the adjacent property to the east by vines (or .comparable plants) planted along the existing chainlink fence for a distance. of approximately twenty (20) to thirty (30) feet measured southeasterly from the most northerly corner of subject property past the closest parking 'space. Said plan shall include the exact plant species, size and pacing and shall be submitted to the Planning. Department for review and approval'. 2. That subject property shall_be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and_whch plans are on file with the Planning Department. marked Exhibit No. 1. 3. That within a period of ninety {90) days from the date of this decision, .Condition Nos. l and 2, above-mentioned, shall be complied with.; Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 4. That approval of this application constitutes approval of the proposed request only to the..extent that it complies with he Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval-.does not include any action or .findings as to compliance,or approval of the request regarding any other applicable ordinance, regulation or requirement.
