OPPOSITION: No one indicated their presence at the public hearing in
opposition and no correspondence was received.
REQUEST: Petitioner requests waiver of the following under authority of Code
Section 18.12.060.020 to construct an 81 sq.ft. monument sign:

Having been appointed Zoning Administrator by the Planning Director, pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the date
set forth above, I do hereby find:
1. That there are special circumstances applicable to the property consisting
of -the location and surroundings which do not apply. to other identically
zoned properties in the vicinity, because the line-of-sight along La Palma
Avenue to subject restaurant and property is obscured by the curvature of
the street and because subject restaurant is the only business on the
property; and, therefore, a monument sign will provide more adequate
identification of the use and its access. driveway; and
2. That the request is approved, in part, permitting a smaller and lower
monument sign than proposed; and, further, that the existing wall signage
`will be retained without any modifications being made as are shown on the
submitted exhibits.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for waiver of type of permitted sign to construct an
81 square foot monument sign on an irregularly-shaped parcel of land consisting
of approximately 1.8 acres, having a frontage of approximately 273 feet on the
south side of La Palma Avenue, having a maximum depth of approximately 395
feet, being located approximately 435 feet east of the centerline of Imperial
Highway, and further described as 5750 East La Palma Avenue; and that the
Planning Director or his authorized representative has determined that the
proposed project falls within the definition of Categorical Exemptions, Class
11, as defined in the State EIR Guidelines and is, therefore, categorically
exempt from the requirement to prepare an EIR.
Based on the evidence and testimony presented to me, I do hereby determine to
APPROVE Variance No. 4145, IN PART, subject .to the following conditions:
1. * That trash storage areas shall be refurbished to the satisfaction of the
Department of Maintenance to comply with approved plans on file with said
Department.
2. That a Plan Sheet for solid waste storage and collection and a plan for
recycling shall be submitted to the Department of Maintenance for review
and approval.
3. That the current trash enclosure shall be modified in accordance with
Department of Maintenance standards and that two (2) recycling storage
areas shall be provided, as required.
4. That plans submitted for building permits shall show conformance with
Engineering Standard Plan No. 137 (including Note No. 2) pertaining to
sight distance visibility.
5. That subject property shall be developed substantially in accordance with
plans and specifications submitted to the City of Anaheim by the
petitioner and which plans are on file with the Planning Department marked
Exhibit Nos. 1 through 3; provided, however,
(a) That the proposed monument sign shall not exceed eight (8) feet in
height, that the display area shall not exceed seventy two (72)
square feet (each side of the double-faced sign) and that the
location shall be relocated out of the public right-of-way; and
(b) That the existing wall signage shall not be modified and shall remain
as follows: "Keno's" on the north face, "Restaurant" on the west
face and "Keno's" on the south face.

6. That prior to issuance of a building permit or within a period of one (1)
year from the date of this decision, whichever occurs first, Condition
Nos.- 2 and 4, above-mentioned, shall be complied with. Extensions for
further time to complete said conditions. may be granted in accordance with
Section 18.03.090 of the Anaheim Municipal Code.
7. `That prior to final building and zoning inspections, Condition Nos. 1, 3
and 5, above-mentioned, shall be complied with.
8. * That approval of this. application constitutes approval of the proposed
request only to the extent that it complies with the Anaheim Municipal
Zoning Code. and any other applicable .City, State and Federal regulations.
Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance,
regulation or requirement. Conditions marked with an asterisk (*) are
required by'established laws, codes, regulations and agreements and are,
therefore, not subject to negotiation.
This decision is made, signed, and entered into the file this twelfth day of
September, 1991.

NOTICE: This decision shall become final unless an appeal to the City Council,
in writing, accompanied by an appeal fee, is filed with the City Clerk within
15 days of the date of the signing of this decision or unless members of the
City Council shall request to review this decision within said 15 days..
