OPPOSITION: Six people indicated their presence 'at the public hearing in
opposition with one person speaking in opposition, and no
correspondence in_opposition was received.
REQUESTS Petitioner requests waiver of the following to retain a bathroom. and
laundry room in an existing garage:
SECTIONS 18.06.040.020 - Minimum dimensions of aara~c.e parking
18.06.080 spaces.
18.12.060.110 (10' x 20' required;
and 18.34.066.020 11' x 16'4" proposed)
Having been appointed Zoning Administrator by the Planning Director,. pursuant
to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced
petition and a public hearing having been duly noticed for and held on the date
set forth above, I do hereby find:
1., That the proposal is in a residential condominium complex where the
existing number of parking spaces is already legally nonconforming because
the complex was developed under less stringent parking standards than are
currently required (minimum 1 covered space per unit versus the current
2 covered spaces per unit);
2. That the proposed garage depth (16'-4") is significantly shallower than the
Code requirement (20'), and standard and large vehicles would not fit; and
that the modifications (structural, plumbing, etc.) for the bathroom and
laundry room are significant and not easily. converted back to garage use in
the event that subject property is sold;
3. That there are no special circumstances applicable to the property such as
size, shape, topography, location or surroundings, which do not apply to
other identically zoned properties in the vicinity because subject property
is:located in a condominium complex containing other similar units with
single garages;

4. That. strict application of the Zoning Code does not deprive the property
of privileges enjoyed by other properties in identical zoning
classification in the vicinity; and
5. That approval of this variance-would establish an undesirable precedent
and may encourage other similar requests in multiple-family parking
complexes which already have fewer parking spaces than required by current
node standards.
CALIFORNIA ENVIRONMENTAL OUALITY ACT FINDING: That the Zoning Administrator
has reviewed the proposal for `waiver of minimum dimensions of garage. parking
spaces. to retain a bathroom and laundry room in an: existing. garage. on a
rectangularly-shaped parcel of land consisting of approximately 1,800 sq.ft.,
having a frontage of. approximately 24 feet on the north side of Glenoaks
Avenue, having,a maximum depth of approximately 75 feet, .being located
680 feet west of the centerline of Euclid Street, and further described as
1781 West.Glenoaks Avenue; and that he Planning Director or his authorized
representative has determined that the proposed project falls within ,the
definition .of Categorical Exemptions, Class 1, as defined in the State of
California Environmental Impact ,Report (EIR) Guidelines` and is, therefore,
categorically exempt from the requirement to prepare an EIR.
Based on the evidence and testimony presented to me, I do hereby determine to
DENY Variance No. 4176.
